Ob the I864ez Packet, we need to send employment letters/

is that for the sponser(petitioner) or for both Petitioner(hubby) and beneficiery(me)???

i don't know, i would think it is just for the petitioner but someone else can chime in.

i have another question about that too. i work for a large school system. do you think it will be enough for me to get an employment letter from my principal at my school so i don't have to go through all the headache of getting someone at central office?

LOL like you said I dont really know but im sure someone else can chime in!.:wink: Hopefully you dont have too, but most likely you are going to have to go through the central office!.....good luck!!

It's the letter of employment of the sponsor to demonstrate the ability to maintain the income overtime.

What kind of letter? Are the transcripts enough to prove the income?

On the jame's shortcut says to send and employment letter along with all the other doc! for the I864

Job Letters and Proof of Income. Pay stub(s) showing income for the most recent 6 months and letters from all current employers are no longer required as initial evidence. The applicant, however, may submit either or both of these items (1) in response to a request for additional evidence (RFE), or (2) with a Form I-864 if the applicant believes doing so would help establish that the sponsor meets the governing income/assets threshold. If submitted, letters from current employers should show dates of employment, the nature of the job, wages or salary earned, number of hours/weeks worked, and prospects for future employment and advancement. It should be sufficient for the employer to say that the employment is of indefinite duration or words of similar effect. Promises of future employment are not required.

On the instructions, it says:

You may include evidence supporting your claim about your expected income for the current year if you believe that submitting this evidence will help you establish ability to maintain sufficient income. You are not required to submit this evidence, however, unless specifically instructed to doso by a Government official.


My bet is that to be on the safer side, just send one if it's possible to come up with the employment letter.... just because on the word however on the intructions.....

oh wow i'm SO glad the 6 months worth of pay stubs aren't required!!!! i have NO idea what i have done with mine!!!

Ok JMRJ thank you

my husband has been on EDD for the last 4 months and just started working on monday......how does this affect in the I864 part!...
Im submitting the tax returs and w-2, He did make enough acorring to the Poverty lines 125% for the last tree years.....

will that affect it in any way

i know we dont have to submit any paystubs, but what do we do in case of a (RFE)???

M -- It is the income of your most recent tax return that will be given the most weight of meeting the poverty guideline requirement. Your husband's income will only be considered if it comes from authorized employment - meaning if he is lawfully working. If not, then you have to meet the income guideline from own.

MMGCA, If your under the poverty line you will need someone to sponsor you. I haven't even check that I think I need to do that. I believe it's the petitioner that needs to fill it out or the sponsor.

We do meet the requerements....i was soo happy when i compared our 2007 tax returs with the 2008 Poverty Guidlines we even went over by like $300.00 bucks!.... so i dont need to look for a sponser wich is great b/c not alot of people are willing to help you out with that!

Perez I would check, just to be on the safe side, that way you dont delay your case if you need a sponser!....

I never sent in any copies of letters or bank statements with our I-864EZ. We only sent in tax return and W-2 for latest year. I think this is only required if you sent in 2007 tax return not quite meeting the poverty level and then got a big raise in 2008 which would make you qualify.

ok that's good to know...today i emailed a lady in HR in the central office who helped me out with a salary problem last year. i guess it pays to have contacts because i explained to her how i needed a letter and didn't want to be given the run-around trying to get it (we call it the "north avenue shuffle" because every time we go there--it's called north avenue--we have to "shuffle" from office to office trying to track down someone competent--kind of like uscis lol) and she said she'd just do it for me so i wouldn't have to go through all that. so i will have one anyway, plus i'll send the transcripts or returns, whichever i locate/receive first, and hopefully they'll generate my ds-3032 sometime in the next week so that i can get crackin.

btw one of my students told me not to say "get cracking" anymore because it was a gang thing. isn't that weird?
