]I just got off the phone with an "immigration" specialist and he recommended that I file a fiance visa instead of doing the i601. Because my boyfriend as never been detained or fingerprinted, he says that my success rate is much higher than with the i601. He did ask me if I could prove that we've had a relationship, which I can. I have flown to his hometown and stayed there. I have phone records, loads and loads of pictures.
Now I'm confused!!!
He also said that the success rate for Juarez is less than 40%!!!
At times I feel like I'm going in circles!
I read the info here and it really keeps me postitive, then I talk to people who claim to be specialist and they shoot me down!!!

did you file for him already. also did you read the Sticky in the I601, you'll get lots of great info. there. Don't jump in to something being confuse...Someone else may give more input..Good Luck

Don't talk to this person anymore. They don't know what they are doing.
You file for a fiance visa (I-129F) first.
You are denied that visa at an interview (currently open time after approval).
Then you file an I-601 and waiver packet.
If things go well, you are approved that day for the visa.
The medical exam is first, then the K-1, then the waiver (I-601) appointment. All of these appointments are in CDJ.
We are doing the fiance visa, but need to do a wiaver to. It's not a one-or-other thing in our cases.

I agree with gatita- the person you spoke to has no idea. I looked at your history and you indicated that your fiance entered the U.S. without a visa previously. If that's the case then a fiance visa is not enough. You will need a fiance visa AND an I-601 waiver. That is if you qualify, etc. So sorry you're getting strange information out there. It unfortunately is common that even attorneys don't know about the waiver and the process around it.

This "immigration specialist" sounds sketchy. Be very careul seeking legal advice from someone who is not a lawyer. Even with lawyers, we have all found that many of them also have no clue about this process.
As for the low approval rate, I'm not sure what the exact numbers are, but the approval on this site is really very high - above 80-90% I believe - and cases that are not approved have extenuating circumstances such as multiple entries, criminal issues, etc. Hopefully someone will chime in with exact statistics on approval rates so we can set this straight for you.

welcome, fourever, and ditto to what everyone else said. dude, anyone could call themselves an "immigration specialist." you have no idea what his credentials are and like ana maria said, even lawyers don't always know what's going on. on this site, you will find real, honest info that will get you the best results possible. and if the "specialist" was insinuating that you lie since he has never been printed/detained, that is a BAD idea. NEVER lie to USCIS. he's been here illegally, and that's exactly what you're going to have to put on your forms. if you lie, you could screw things up forever. just tell the truth and get started on your i-129f after reading the information link in my signature to check and see if you're eligible. how many times has your fiance entered the US?

Yes, I agree, CDJ has the highest percentage of approvals of all the consulates, right? And you need to find a waiver specialist, not an immigration specialist. Seriously last week my brother's friend, an immigration lawyer told me I could just pay a fine for my husband and adjust his status. That is an old law, and they sometimes have ancient info. I recommend you get a consultation with a waivers specialist

Dont waste your time and money taking to this "immigration specialist" I did waste my time and money visiting "one of the best lawyers in the bay area" WHATEVER! This guy didnt know anything! "There IS NOT WAY you can fix your situation here without the 245i" he told me, he didnt even mention a waiver!

This "specialist" has no idea what he is talking about. A fiancee visa will have to be accompanied by an I-601 waiver for his illegal presence, there's just no way around that unless you lie. And lying can result in a lifetime ban.
Warren Janssen, the OIC for the CDJ consulate, has said himself that the approval rate is about 80%.
Seriously, this specialist has no clue. Much like my first attorney.

We also paid $300.00 to help with our I-130. I didn't know about this site....... After i found it, every time i have a question or when i get a form, i just ask here, everyone is really nice and willing to help.
also try to do research online.....its amaizing how many info is out there!.

Call Annie! She is a good lawyer who works a bit with Laurel Scott. She'd know just what to tell you.
Don't ever trust these lawyers until you know for sure that what they're telling you is right. There are too many scary lawyers out there who have no idea...

I'm guessing that "specialist" was suggesting that you file for the fiance visa and then pretend your man had never been here before. Totally shady. Don't use immigration specialists.
The approval rate in CDJ is WAY over 40%. If that person has a 40% approval rate it means they don't know what they are doing. If your fiance doesn't have a criminal record or any other complications, you have an excellent chance of a quick approval.
