I tried to procure a visa by lying to an officer. Looks like they didn't figure that out and I was denied under 221g. Now my interview is coming up and my lawyer says I'll have to admit and have the waivers ready. So I am going to need to waivers: overstay + misrepresentation/fraud. I found this perfect guy whom I am married to now, and I love him to death. I am so depressed. what do I do now?

thanks in advance

The best place to start is reading the "stickies" above this thread and the ones in the Juarez forum as well. Once you've read them you can make an informed decision as to whether or not to hire an attorney to complete your waiver package.

You will need to prove that your not being allowed to enter the U.S. would cause "Extreme Hardship" to your husband (qualifying USC petitioner.) This can be difficult but the information here WILL help you.

Good luck, come back if you have more questions, or want help brainstorming "hardships!"

Hi lovefinns :)

Can you give us more details ?

Are still in the USA if not what country are you in? What status does your husband have (USC, PR etc ) ? The upcoming interview is for what? AOS based on marriage (if you are in-country)? To conclude the application for whatever visa it was you were seeking to obtain? What visa did you try to obtain? What status do you / did you have ? How did you enter the US ? How long was your overstayed? Can you give us a time line i.e. put everything into a sequence of events ? Yes you will need a waiver but if you give us some further info then perhaps there's someone who has been through a similar situation can provide you more help :)

I am not in the U.S. anymore. My husband is a USC. So if I admit everything I get to use a waiver? I am in India. Are waivers adjudicated right away?

I tried to get an H1B stamp. Overstayed for ~ 1.3 years.
