Dear Sir or Madam,
I, XXXXXX, declare under the penalty of perjury, under the laws of the United States, that the following is true and correct:
I am submitting this letter in support to the I-601 waiver petition filed for my wife, Mrs. XXXXXXXX
Before anything I want to point out that my wife was brought to the US without inspection at age 13 in the year 1997 almost 11 years ago and has never left the country ever since.
My wife is asking U.S. Citizenship & Immigration Services to waive this ground of inadmissibility under section 212(a)(9)(b)(v) of the act as much as refusing her admission to the United States will result in extreme hardship to me and my United States Citizen Child. My Son and I, as U. S. Citizens, urge and plead for you to allow my wife to return to the United States of America. Our only infant son age 22months old and I need her now more than ever in all the areas of our lives. If I leave the United States to be with my wife in Mexico, I will have to give up my life, my job and home based business, health insurance, and friends in the United States and relocate to Mexico.
I. Introduction.
My wife and I were married on August 15, 2006. Since our marriage, my wife and I have never been separated. My wife and I have one United States Citizen Child: Ethan XXXXXXXX (age 22 moths) Ethan Alexander was born on July 15, 2006.
II. Health
I suffer from chronic depression. I also suffer from chronic environmental allergies. I am under constant medical supervision because of the two medical conditions. In addition to the depression and environmental allergies, I am at high risk of type 2 Diabetes. My mother and one of my brothers currently suffer from it. One of my uncles died of diabetes recently. Two of my aunts currently suffer from diabetes. If we had to relocate to Mexico not having my doctor of twelve years will result in extreme hardship to me.
A. Chronic Environmental Allergies and Depression.
To keep my allergies under control I have to take several medications regularly such as Zyrtec, and Flonase. Without them I can’t function through out the day. I’m allergic to mostly everything on the air perfumes, pollen, dust, to cats, and dust mites. My allergies are triggered almost every day and to be able to control them I need to take my meds. For my chronic depression I take PROZAC 20 mg. I had not required to be medicated for my chronic depression in along time until I found out that I might be separated from my spouse. The fear of being separated from her and the stress of relocating and losing all of our commodities has had a toll on my physical and mental health. Specially, the possibility of having to live without my wife for a long period of time, is the reason of constant worrying, lose of appetite, desire to go to work, desire to go to the gym, and the desire to do almost anything. It will be a real challenge to deal with her absence. I don’t know if I will be able to cope with her not being here with me and our son to offer her support and comfort.
B. Due to my Illnesses and Depression I have to be in good shape.
To help overcome my depression I have to exercise daily and have healthy diet. In the United States I belong to a gym 24 hours Fitness and have access to a lot of information and support when it comes to eating well and living healthy. Considering I am at high risk, the lack of access to good, affordable health care options would put my health in grave, immediate danger. The inability to ensure my own personal health, particularly considering my family history and great risk for heart disease would cause extreme hardship, stress and anxiety in my life. The combination of poor diet, lack of exercise, no preventative medical options nor access to good emergency care could be fatal.


III. Health Care and Employment.
If my wife is not granted waiver of inadmissibility, my wife will not be able to return to the United States for ten years. I will then have to leave the United States to be with my wife in Mexico. In Mexico I would not be able to pay for health insurance there since median income in Mexico is $12,500 according to www.cia.gov. Health insurance for me and my son would be $3,263 per year. In addition to the high cost of health insurance, it would be difficult for me to find a good paying job that would allow me to pay for insurance since I lack working skills. I have never worked in Mexico, and cannot legally work in Mexico. In the United States I have a superb health insurance provider, Kaiser Permanente. Kaiser Permanente covers the cost of family doctor visits, lab tests, X- rays, Ophthalmologist visits, Allergist visits, Dermatologist visits, and the cost of all prescriptions and of any surgery if required. I have also developed a great relationship of trust with my doctor and his assistant. I can call them whenever a health related problem arises, whenever there is a need to discuss certain treatment or medication. For instance, I have called my doctor and his assistant several times when I have felt really depressed and have always been there to help me. I feel as if they were part of my family. I have seen them for twelve years. For me not only would it be difficult to find similar health care coverage in Mexico if I am forced to relocate there, but to start a new relationship with a new doctor would be extremely difficult. If I relocated to Mexico I would not be able to afford my medications or those of my son.


IV. Extreme Medical Hardship for Citizen Child.
My son often has trouble breathing at night and has been in the emergency room for that reason twice. My Son had suffered from Respiratory Syncytial Virus (RSV) for several months and at 21 months of age he was diagnosed with Asthma together with an allergy. Ethan requires using a nebulizer everyday at least once morning and once at night. Ethan’s pediatrician, Dr. Maldonado advised us that taking our infant to Mexico would put our son’s life at risk. The prospect of exposing him on a permanent basis to the pollutants that are present in Mexico is of great concern to both me and his pediatrician. ) we still do not know what to expect and how to react if he had an Asthma attack. It will cause me extreme hardship to know that my son’s health is deteriorating and that his mother will not be there to help him is he suffers an asthma attack.
My son requires being under constant medical supervision to ensure his good health.

V. Family unity.
If I remain in the United States, my son and I will be separated from my wife. We are a very united family. It will be difficult for me to maintain two homes, one in the United States for me and my son and a second one in Mexico for my wife. I will not see my wife on daily basis and this will result in a high level of family separation hardships, as husband is separated from wife, wife separated from husband, and son separated from mother. Our marriage will be weakened, and would be an extreme hardship if my wife and I are separated for ten years. It will also be extremely difficult for me financially. Even with my home based business I can barely pay all of our bills. It will be almost impossible to provide for two homes, and I will not be able to provide my wife with a proper home in Mexico.

VI. Conclusion.
If my wife is not allowed in to the United States, my son will have to grow up without his mother. I would have to hire a nanny to care for my son and that will result in extreme economical hardship to me and extreme emotional hardship to the tree of us. The average weekly cost for a nanny ranges from $350 to $500 dollars. I work outside of home most of the day from 9am to 5 p.m. , but depending on the traffic congestion it can take me from 45 minutes to 1 ½ hours to arrive home, that means that I normally leave my house at 8:30 am and return at 6:30. Sometimes after I arrive at 6:30 pm I immediately leave to attend to my art consultant business and end up coming home at 9 or 10pm. That would mean that he would spend most of the time with a nanny.

I will suffer extremely if I know that my son is left without his mother. The never-ending worry that the end result may not be positive threatens my mental and physical welfare to the core. It would be emotionally devastating and cause such difficult hardships for my family to relocate to Mexico for ten years. My wife has helped my live a normal life style and If I lose her and my son I am sure that I will have a relapse with no one around to help me overcome my depression. If my wife is not allowed back in to the United States I will have to close my home based business to be able to spend some time with my son, and I still will have to hire a nanny.

My wife has no criminal record. My wife has never been stopped by immigration officials. I therefore ask USCIS officials to please approve my wife’s request for a waiver of the unlawful presence ground of inadmissibility.

I really did not get the part where you wrote "my wife is asking uscis to wave this ground of inadmissibility under section xxxxxx, she is not the one that needs to ask for this, you are. Her opinion, hardships do not count only yours and you son's as USC. I think it needs a little more work.

Currently I have an apartment lease to fulfill back in California. I have been living in the same apartment building for about 10 years always paying on time and my contract has just began for 1 more year, I also have a car loan to pay off and my cell phone contract to fulfill If I was forced to relocate I would ruin my credit score and worse I could be the object of a lawsuit. I have been running a home based art consulting business which provides a substantial part of my income. I already have an established clientele that I would lose if I am forced to relocate to join my wife in Mexico. I would have to leave my job and my business and therefore leaving everything I worked so hard for.

It seems a bit short and weak to me .. and I'm not sure what kinds of evidence you have.. he should elaborate more on some of the things and explain why they are so drastic..
