Hi everyone, posted a little while ago but i jus got a new question.
on my letter of rejection for my student visa, it does not state there that i can't enter the country on the VWP.
What are the chances that I can play dumb? Its just so much of a hassle if I have to apply for a visa everytime I want to enter the USA.
My bf is studying there, and we were planning on keeping tihs long dist r/s working by having him fly back or me fly over to look for him. we're both singaporeans.
please help!

desiree,
you didn't need a student visa in the first place if your country has the VWP, If it does, you don't need the student visa. you can stay in the USA for 3 months as a tourist, don't say that you're coming to visit your bf.
Is he just studying in the US or is he a USC or LPR?

Singapore does participate in the Visa Waiver program, however:
From the DHS website:
"When does a national of a VWP country need to apply for a visa instead of using the VWP?"
"Nationals of VWP countries must meet the conditions noted in the section above in order to seek admission to the United States under the Visa Waiver Program. Travelers who do not meet these conditions must apply for a visa. In particular, a visa must be requested if the traveler:
- Has been refused a visa or admission to the United States before, or did not comply with the conditions of previous VWP admissions (90 days or less stay for tourism or business, etc.)

So you may run the risk of being turned around if you try to enter on the VWP. Personally I would play it safe and get a tourist visa, or at least check with the embassy in Singapore how this rule is interpreted.

I just read your other posts where you stated that you have been turned down for both a F1 and a B2, and that your VWP eligibility has been revoked. Given this, I would say that playing dumb and try to enter without a visa on the VWP at this point is not a good idea, and not something anyone on this site would advise you to try. You may end up being charged with misrepresentation and end up in a even worse position than what you are in now. If all you want to do is visit for 90 days or less, your best bet is to prove strong ties to your home country, and reapply for a tourist visa. The laws are what they are and apply to everyone, no matter how much you wish it to not be the case. Sorry.
You may wish to engage a qualified immigration lawyer before you proceed any further to help you try to untangle the situation you have gotten yourself into.

I wonder why the US is so anal about having people enter their country. Especially when these people like myself have money to spend, increasing their national income for them am i not?
Well, does anybody know if the removal of the visa waiver is a permanent fixture, or if its temporary? I dunno how I can possibly live my life at the tender age of 23 if i friggin have to apply for a visa just to step into the US.
I'm a big fan of travelling, and to close off an entire continent to me, or at least to make it so inaccessible, its just ridiculous.
By the way my boyfriend's just studying there. He's singaporean, and he's got another 3.5 years to go.

Hi desireefoo. I don't have an answer for you as far as VWP goes and I understand how it can be so frustated to have the money to spend, but the steps to reenter the states just so difficult.
I myself am not allowed to reenter the US until my waivers approved. I have been away from my husband (the US citizen) for 14 months. As many of us on this site experiencing, this waiver process is tough and we have to be away from our love one for so long.
All I can say, the law is there, whether one would like it or not, we just have to follow it.
For me, I guess I have to be grateful that there is waiver available for me so there is a chance for me to be reunited with my husband in the US even though this waiting game is getting tougher for me (however, our marriage is getting stronger)

As far as playing dumb...I wouldn't recommend it. USCIS would have your file in their system. They will find out. Save your money and the hassles of being denied at the port of entry. And then, the process will be a lot more difficult in the future.

Ok so i guess playing dumb is not an option.
i just wonder if my honest ignorance the first time round when i entered the states allowed for an overlooking of my first B2 visa's refusal.
I don't even remember having to fill in any form but apparently there was a question on a form i had to fill in that asked if i had ever refused a visa. I don't remmeber that being asked before, and i'm sure had i answered yes, i would've been stopped. so i must have answered no, thinking that they meant to ask me if i was ever stopped at the customs and turned around.
so an honest mistake on my part, but then again that was a tourist visa. does that not count towards a Visa Waiver being removed?
Help help help...
this is so frustrating. I still dunno if i can get my VWP reinstated!
