With just one month to go, the U.S. Citizenship and Immigration Services (USCIS) has reminded nationals of Burundi eligible for Temporary Protected Status (TPS) to file a re-registration application for TPS by the closing date of December 28th, 2007. Failure to file a TPS re-registration application by December 28th will result in the withdrawal of TPS benefits, including employment authorization (http://www.visapro.com/US-Immigration/USA-Work-Permit.asp) and protection from removal from the United States.
What will happen if TPS is withdrawn?
If TPS is withdrawn from an individual and he or she has no other valid immigration status, the individual may be deported. There are approximately 30 Burundians (or aliens having no nationality who last habitually resided in Burundi) who may be eligible for re-registration.

On October 29, 2007, the Department of Homeland Security (DHS) announced the termination of the TPS designation for Burundi in the Federal Register, but the effective date of the termination is delayed until 12:01 a.m., May 2, 2009. (72 FR 61172). Nationals of Burundi (and aliens without nationality who last resided in Burundi) who currently have TPS must re-register during the 60-day period from October 29, 2007 through December 28, 2007 in order to maintain their TPS status during the 18-months until the termination of the Burundi designation becomes effective.
How to re-register for TPS?
To re-register for TPS, a TPS beneficiary must submit:
Form I-821 (http://www.visapro.com/US-INS-Forms/Temporary-Protection-Status-Application.asp) (Application for Temporary Protected Status) without the filing fee
Form I-765 (http://www.visapro.com/US-INS-Forms/Form-I-765.asp) (Application for Employment Authorization), with fee if requesting a TPS-related EAD or an extension of a TPS-related EAD
Biometric fee if the beneficiary is 14 years of age or older or is under age 14 and is requesting an EADNote: Applicants requesting an EAD may request that the Form I-765 fee be waived in accordance with 8 CFR 103.7. The biometrics fee may also be waived based upon an inability to pay the fee. Applicants must submit both the Form I-765 and Form I-821 for re-registration.
The fee for Form I-765, Application for Employment Authorization, is $340 and the fee for biometrics service is $80. To facilitate the processing of TPS re-registrations, the USCIS has strongly encouraged the applicants to file as soon as possible and not wait until the end of the re-registration period.
