View Full Version : HIB visa holder marrying a USC

Hello everyone,

My brother in law came to the US to work on an HIB visa about two years ago. Two years later he has met the love of his life (who is a USC) and wants to get married but he wants to be careful about his status with his visa and make sure that he does not do anything stupid that will bite him in the tush later or to bring any problems to his fiancee. The question is can he marry her and become an LPR or would he have to go back to his home country and wait for her to file his I-130? and if he could, what would be the process? I appreciate anyone's input. Thanks,

He should be able to marry and do an adjustment of status and not leave the U.S. It's different because he entered with a visa. So even if he does overstay at some point before the paperwork is done, he shouldn't have a problem.

Latinlaw, hes on H1, therefore, hes legal... So he shouldnt have any problem marrying his gf and get a GC... it will be faster...
