Hello everybody! I'm new here and the only reason I am here is because of a wonderful nurse from the hospital that was treating my husband for appendicitious(sp). My husband is from El Salvador and we have a beautiful daughter Madelyne Suzanne. I'm hoping to find some way to get his TPS back or any information that will allow me to be able to file for him to become legal in this country again. He had his TPS and then about 3 months before we were married he was denied and his lawyer couldn't explain it. We contested the denial and have heard nothing. We do not know what to do and from what I've been able to find there is nothing we can do short of him leaving the country for at least 3 to 10 years before I could file to have him come back into the country. He's the love of my life and the most incredible father. I can't express in words how my life would be shattered if he were to be forced to leave the country I was born and raised in an have loved my whole life. If anyone has any information that could help please let me know. Thank you so much!

Leigha - You should be able to file a waiver (I-601) of the 3/10-year bar that may exist on your husband once he leaves the country. Do not despair. Others will chime in, but you shouldn't have to be separated for more than a year or so if you pursue his legalization.

When did his TPS get denied and how long did he have it before it got denied? When you say you contested the denial, do you mean you filed an appeal? We appealed also when my hubby's TPS was denied. How long has your hubby been here and did he EWI?

My hubby has been here since 1999 and has had his TPS since 01. He was denied in 04. We think it was because the paper work was filed wrong. After we were married almost a year we got a letter saying we could file an appeal and we haven't heard since then. Now adding to all this wonderful mess when we called his lawyer the other day his phone had been disconnected. But I'm sure we have more than enough proof that he's been in the country the whole time.
