I have a question. If someone is here on a 6 month visitor visa I believe it's a B1 or B2 visa (Europe) and this person wants to get married to a LPR.... residence for over 30 years. What would be the legal way to adjust her status and how long would the process take? Any help would be appreciated.

The person on the visitor visa should return to their country. The USC Fiance would file a I-129F. Once it is approved it will be sent to the consulate in Europe. The European Fiance would then get an interview for their Fiance visa. Once they return to the US they have 90 days to get married. You would then file an I-485 for Adjustment of status.

This is assuming there is no illegal presence more than a year. If they have illegal presence over a year they would want to stay and file the Adjustment of Status packet.

Thank you Angela....but her boyfriend is a LPR for 30 years... he never filed for USC...I guess he was to lazy.

Her mother is a USC but she doesn't live in the US she lives in Europe. Her aunt is also a USC living in the US. Is there anyway she can adjust status here in the US? She did not overstay her visa.
