Hello everybody!!
I am new on this thread. I hope somebody can answer my questions:
My sister got married to a Mexican that let her believed he was a USA citizen. However, after some months of their marriage my sister found out he is not USA citizen. She decided to continue with her husband because she has strong feelings for him. Somehow, he is not able to adjust status in the USA, I do not know the reason/s. My questions is:
1. As a Mexican citizen, it is easy to move to Canada?. I read or heard something about Mexican being able to obtain residency in Canada just because they are mexicans, is that true?
2.Can my sister obtain a mexican residency in order to move to Canada, too?
3. What are the chances of moving to Canada without having no college education?
I really appreciate any answers.

Why do you feel he can adjust status? Has your sister thought of applying for papers for him?

When you say "adjust status" -- are you saying he can't do an in-country AOS? That is because he probably entered without inspection, but maybe he is eligible for the I-601 waiver and she is just not aware of that process?
As far as Canada, there are other threads about that. I'm not sure it's that simple. He definitely cannot, as a Mexican citizen, just decide to move to Canada. I believe they will both need job offers to be able to reside there.

Moving to Canada can be tricky. Your best bet is to hire an immigration lawyer who can walk you through the process.
Why not have your sister file the I-130 for her husband... Read all the information in Laurafern's signature, it's got the answers you need.

Hey billchris: welcome . Let me tell u that all the info here has to do with people from abroad ,mostly mexican living in the USA. most of us entered without inspection ,better said, we enter illegally to the USA. If your brother in law is an ilegal in the USA,the only way he can become legal in the USA is getting merried to a USA citizen ; if ur sister is NOT a USA citizen but lives here too. their best hope is just to wait until the congress passes a new inmigration reform, cause right now we can hardly do anything about our status. when they say to fill out a I-601 form they are talking about USA inmigration law. its for people here ilegally ,married to a US permanent or leagl resident or to a USA citizen. Canadian law is totally a diferent ball park . It would be very easy for ur sis to become a legal mexican resident and for them 2 to move to Mexico and once there she 'd try to get the right documents for her mexican husband. because here IT IS VERY HARD ;CLOSE TO IMPOSSIBLE.But the lure of the States is mostly the american dollar which nowadays is kinna weak. My humble advice for them'd be to start a if possible in Canada. and if thats not possible they might consider going to mexico for a couple of years and then to your country. I 've here 18 years ,i am married to a american citizen .PRAISE THE MOST HIGH!!!, we have everything, EXCEPT the famous green card. my only chance is geeting out of the country and go to Mexico( since im mexican) and then apply for a I-601 waiver which is a from where the USA citizen and spouse ask for forgiveness from the goverment because of the spouse that entered ilegally to the USA; then they MUST demostrate something calledEXTREME HARSHIP for the USA citizen is case the pardon is denied to the spouse. The fact is that the officer that grants this "forgiveness" many times does it at his/her own discretion, many couples with one spouse being an american citizen and having 2 or 3 american children are denied the waiver, and they wind up GOD knows where and the poor kids .... forget it ; i believe that those kids are gonna be the people talking the place of the ilegal aliens now in the country, because once they are forced to move out the country, they do not have the same opportunities as they would've in the States and also if they (even) learn english ,they are gonna be discriminate against the same way that we are, because they are gonna talk with an accent. I already know a couple of american citizen in this situation. Their parents are forced to move out of the country ,when they reach 18 they come back but sometimes they dont speak english and if they do , its with an accent. The ones that i know are busting their tail sometimes worse than the ilegals and i know a couple of them that make less money 'cause they speak the language. Please read as much as possible here; and tell your sister to be aware of this situation. Some of us have no choice because we have children and this is their country. I wish your family the best. Hello and Thank you very much for your response.
Well, let me try to explain my sister situation.
She enter with a tourist visa and overstay. Her husband, is a mexican citizen who resides in the USA. As to, how he enter the country or if he try to adjust status, I do not know. The problem is that my brother in law told my sister that he can not fix his legal situation in the USA. I do not know exactly what he did, but aparently he is well informed that there is no way he can fix his situation ( not even marrying a USA citizen). Since my sister enter with inspection she is in the position to fix her status if any new law pass, right? But, now the problem is my brother in law. So, My sister and myself heard about Mexicans being able to migrate to Canada with little effort. However after reading your responses it seems that's no the case.
They both do not have any college degree.
I though that would be easier but it seems that it is not going to be.

ohh so they are both out of status :( their best bet might be to wait for reform..
They should not give up on Canada just research it some more..

Hey billchriss: In yesterday's postings i believe they have a lady from Canada helping ilegal mexicans and even some american citizen to get jobs and lawful status in your country; al this in the state of Arizona i believe. I think my sister will need to wait for any law that can help her. As to her husband I do not know How eventually his situation will be fix. Probably with my sister in a legal status can do something better for both of them, as to going to another country, I do not.
