I have gotten no information other than a letter from NVC acknowledging receipt of my file. The I-130 has not been forwarded, but the I-129F has.

Here is the email I got from my Senator's office a few minutes ago.

Mrs. Blah Blah has an appointment scheduled on May 14, 2008 at 6:45 am. Appointment letter with forms and instructions was sent to petitioner’s address by regular mail.

If you need more information regarding this case please do not hesitate to contact us.

I just searched DJs posts to see when they were approved and...
The I-130 was approved 3/12, and the I129F on 3/11 in Cali.

That is SUPER fast...

Sent I130 Aug 12, 07. NOA1 Sept 15, 07, or so. Sent I129F about Nov 10, 08, NOA1 Nov 25, 08

NOA2 for I129F Mar 11, 08. NOA2 for I130 Mar 12, 08.


The thing is....her I130 was never forwarded, just the I129F. I want her to come home ASAP, of course, but the I130 is still not at the NVC, just the I129F. My senator's office sent me this link:

So according to that, the I130 will be used when I apply for her AOS after she is here. However, if I want the I130 to be processed, I need to write a letter and ask that the I130 be processed at the consulate, right?



I am kinda lost here, and not sure what to do. Yeah, I want her to come back, of course, but what happens when she comes back with I129F, and visa. She can't work or do anything until the AOS, right? After filing AOS, can she be denied?


I just want to choose the golden path.

Help.

DJ there is always a slim possibility that your AOS be denied but the question is why would it? Are you really married? Are you hiding anything? If the answer is yes to first and no to second then you should be fine. The process is a little frustrating for AOS but it's not as bad as waiting over a year in Mexico for a waiver approval.

I say don't mess with it and just go to your K-3 appointment. You wife will have a visa where she can travel in and out of U.S. and will be legally in the U.S. You have no idea the relief that will bring you. You will feel the burden lift off your shoulders immediately. She won't be able to work until her EAD is approved which takes about a couple of months from filing. Not too bad. :)

DJ - I have been trying to get my I-130 sent too so that we can get an immigrant visa.

1. I was told by USCIS on April 4 that they no longer had the applicaiton and it had been sent to NVC.

2. USCIS touched the I-130 on Apirl 9th! So it is not on it's way to NVC at least at that point.

3. Laurel told me to wait it out at least 2 more weeks and NVC said 90 days from approval.

So confused. Why doesn't anyone care about the mood I choose? I mean, I took the time to change it, but no one wants to look at it?! Come on!! :D

Oh, and the immigration thing.....lol...yes, we are married, and I have tons of things to back it up, no questions asked. It will be five years this August, so USCIS can kiss my tooshie if they doubt me. But still, I am worried about her coming back, and not being able to work, and all that good stuff. Can she get a license? Can she get a SSN? Can she get a job? Am I gonna come home to 494895034742 kids besides suddenly my wife is bored and decided to start babysitting and never told me about it?! I mean, I am gonna wanna make up for lost time, ya know!


Forgive me, but if I don't laugh about some of this stuff, I will kill myself.

Angela I would call now. I only waited 4 weeks because they said it should take 2 to 4 weeks. Call USCIS and ask them to do a service request to track down what happened to the I-130.

ooooooooh doesn'st that make you ANGRY????????? some people are forwarded in 2 days and others have to wait 90??? bah.

it is so weird how they choose these cases....talking to my wife today, she got an email from her friend in Chicago....applied in October, interviewed in Jan, here in early Feb.

What do I need to do now, if anything? I know I need to get a hotel in CDJ for the wife, her airline tix, etc. What else? Do I need to make a second appt at the consulate for anything?
