"Absconder" is the ugliest word I have ever known. I just recently learned that my loved-one fits into this category, which makes her even more targeted by ICE than an EWI immigrant. Her status is making it very difficult to find affordable, legal representation. But, we're not giving up. Not ever giving up!

I agree it is an unfortunate term, but I think "alien" and even worse, "illegal/illegals" used as a noun is the worst.

Anyway... Jimmy - for your case it's going to be almost impossible to find affordable representation. If you cannot afford a good attorney, someone who is experienced in I-601 waivers (like Laurel Scott) or with abuse/VAWA cases (like Heather Poole) you are probably better off doing a ton of research, a few consultations, and going ahead with the process on your own.

I would strongly recommend you consult with Heather Poole to see if there is any relief for your fiance based on the brutality you mentioned in El Salvador as well as Laurel to see what she thinks of your chances with the I-601 waiver through there. At that point you will have some excellent opinions and will be able to consider your options and move forward without actually hiring someone.. just a thought.

jimmyhat, I didn't realize until after we filed the I-601 that my husband was considered an "absconder", and thank goodness because it is a very discouraging word. But I am here to tell you that even though he was an "absconder" and then eventually followed by a deportation, we still had our waiver approved and he came back to the US last month. You are right in not giving up hope. It can be done!

In it's simplest form, absconders are immigrants who have had their day in immigration court and have disobeyed a final order of removal. From what I can tell, absconders are targeted a little more aggressively for removal. No more second chances to leave on their own, essentially.
