So I already sent in my AOS packet (marriage based with USC husband) and Immigration already received it.
I want to know after you receive what paper is it that you can obtain a drivers license and Florida ID?
Is it after the biometrics that you are able to get these?
(I already have an SSN btw, since '92 when I got here, the card just says that I can't be employed but that'll obviously change after this process)
My lawyer told me that he had a client who has received all these papers in as little as three weeks and is already able to work and get a Drivers license.

I'm not sure but I would call the DMV and ask them what they require to get a DL.

But I think with an Employment Authorization you already can.

got my florida DL with my paperwor... but employment authorization does not come within a few weeks, it takes about 2 months or more!

I'm confused.... I am sending my husband I-130 when we get the I-797 NOA will he be able to get his drivers license we also live in FL????

There is a lot of confusion on this. It depends on which DL office you go to. We were told no when we went but there have been others that received theirs. I just do not have the time right now to call around and find one that will say yes.

Yes, he has a passport (mexico) but he doesn't have the I-94 because he came in illegally

How long ago did you get it without the I-94? I'm wondering if it's more easier to get it in some parts of FL than others

about two months they started requiring i 94 but they might renew it for a year if you already hav a dl and are in process of getting your papers.

If you have a social security number then I'm sure you can probably obtain the license. I spoke with several offices in Florida a couple weeks ago and so far it's the same, with a NOA(2) I-797 Approval you can obtain the license. If you're in an office and they say no, you can't, then ask them to call Tallahassee and verify it. Too many of these clerks haven't dealt with immigration-related matters and they don't know the specifics.

whats NOA?
I mean according to what the FL site says:
"Immigrants
Each immigrant who applies for an original driver license or identification card must submit:
1. Alien Registration receipt card, (Green card, Form I-551); or
2. I-551 stamp in passport or on I-94; or
3. Immigration Judges Order, with the customer's A-number, granting asylum; or
4. I-797, with the customer's A-number, stating the customer has been granted asylum; or
5. I-797 or another form from the Bureau of Citizenship and Immigration Services, with the customer's A-number, stating the customer's application for Refugee status is approved; or
Non-Immigrants
Each non-immigrant who applies for an original driver license or identification card must submit:
1. Employment authorization card issued by the United States Department of Justice (Form I688B or I-766); or
2. Proof of nonimmigrant classification provided by United States Department of Justice (Form I-94, not expired, with required supporting attachment(s). If in doubt regarding required documents, please bring all of your INS documentation with you.). I-94s must be accompanied by a Passport. Certain classifications require additional documentation. Some examples are:
* F-1 and M-1 classification must also be accompanied by an I-20.
* I J-1 or J-2 designation must be accompanied by an IAP-66.
* Refugee, asylee and parolee classifications must be accompanied by additional documentation."
I think employment authorization is enough although it says I-766 and i filed I-765. Also it says "or" for the rest of the options, so it's not more than one you need to show. I'm not too sure if I'd be classified under non-immigrant since I filed the papers.

What about driver's license in Alabama? Anyone know about Marshall county,Blount County, Jefferson County, or Etowah County? Will the Social Security Card and EAD be enough?

This is what I found for Alabama:
Driving Privileges for Non-Citizens
You can drive in Alabama for one year, provided you have a valid foreign driver's license and an International Driver's Permit. This permit, issued by your home country, is not a substitute for the foreign license, but a translation of it that makes things easier for U.S. officials to understand. After the one year bubble expires, you must apply for an Alabama learner's permit and pass both license tests (written and road).
When applying, you must present your passport along with one of the following:
* Employment authorization document along with valid Social Security card.
* Valid I-94 arrival/departure record issued by the Department of Homeland Security.
* Original I-797 notice of action issued by the Department of Homeland Security, showing approval of change of status or extension of stay.
* Original I-797 notice of action issued by the Department of Homeland Security, exhibiting timely filing of an extension petition.
* Valid visa authorizing your presence in the U.S. for 160 days or more.
* Valid employment authorization document issued by the Department of Homeland Security.

Epitaph did you recieve something in the mail for your NOA reciept? I sent my paperwork out about the same time as yours and havent recieved a NOA reciept yet.

What do you mean received something for the receipt?
I recieved the NOA type: receipt notice.
It tells me that soon I'm going to receive a biometrics appointment and the documents I should be going with.

Hey well unless things really have changed since 2005. My husband got his drivers license with a birth certifcate of his in english plus mexican passport and I-797 letter we live in florida

I think they have changed a lot, because now to renew a license for some people you have to actually go to the DMV and show papers and stuff, instead of just doing it online.
Idk, I think that I could only get my license with a NOA 2, and I guess that takes a while.

nope. I'll be a first time driver once i do.
I think my lawyer said that with the second NOA notice you can go get an ID and DL.
btw, do they charge when you go to biometrics?

but see if its your first time getting dl you should be able to get it by have the I-797 letter that is one of the requirements to get a dl but it is really different at eacl dl place you go to.

right now i am driving with the paper they give you i had mine renewed 2 weeks ago, since i had a ticket they had me take the road sign test again, and with noas + wife birth certificate + marriage certificate+ 194+ passport i was able to get the DL for 1 year, she said you have EAD? i said not yet, then she said if you had that, it'd be all we'd need

The passport I have now is from my country of origin, does that work?
The I-797 is the NOA right?
Which one? The one I have is only a notice of receipt, I don't think that one will work? If not then which one?

take all the noas you ahve, and your country's passport + whatever document you have!
