HELLO ALL

I am new here and i didnt even know where to start. I am a USC and very confused on where to start in regards to my husband case. He came to the united states In Jan 2000 threw Mexico he is from Macedonia ( he is Albanian) he was caught at the border in Texas and was jailed for 32 days and released. He then came to New jersey to relatives he had here (he was 20 years at the time and not a word of English) Then in May 2000 he was told by a really bad attorney (she was a divorce lawyer) to accept a voluntary departure but he did not have to leave the country. My Husband not knowning a word of English did as he was told. hen in Sept 2000 we met and Got engaged and in Sept 2001 we got married ( two weeks after 9-11). We did not go down to city hall but we got married threw our religion. We lived together and started our Life ( at the time i was a green card holder) i would do research on how to could file for him and went to numerous attorney only for our money to be taken and nothing in return. Then in Feb 2003 we had our beautiful son. Still stressed by the his immigration status we continue to live under the radar. In Dec 2006 from all the stress and all deportation and people being picked up in new jersey My husband got on a plane and returned to his home country. I was 2 months pregnant at the time so i continued to travel twice until July 2007 when i had my daughter. now in Feb i finally got my citizenship wooohoooo! and now am i i didnt know where to start i know that now i will go to Macedonia to marry Legally my husband and i know i have to file I-130 which i know once approved he will go for an interview and be denied but i didnt know what form from start to finish i would need to file and how to go about this in the quickest way as we have been apart so long it is killing both me my kids and him. My son is now 5 and will need to start school in Sept and he daily asks for his father when he will come home. please please someone help me in figuring out what i could do to get my husband home SOON thank you

I hope the best for you and your family, there are a lot of people here that will be able to point you in the right direction.

After the I-130 is processed you will need to file a waiver I-601 along with a hard ship letter. This is what I had to do for my husband, it is a long and grueling process but this site is full of very helpfully information and people.

YES THANKS FOR THE REPLY IT HAS BEEN SO CRAZY I AM WAITING TIL END OF JUNE TO GO TO EUROPE AND MARRIED AND I WILL SEND DHL FROM THERE SO I DO NOT LOSE ANYTIME. WHAT DO I NEED FOR THE WAVIER EXACTLY ANYONE KNOW?? THANKS FOR YOUR HELP I KNOW ITS GOING TO BE A LONG HARD JOURNEY :please::bang:

for the waiver, you will need a letter proving extreme hardship to YOU if you were forced to move to your husband's country or live here without him. you can talk about your kids in it as well. read some of the approved HSLs here and you'll get an idea.

Hi Vala...

You may want to read the Vienna thread. A lot of us with loved ones from that region had to file through that office- you will get a lot of information from that thread.

Welcome to the site and good luck! Sounds like you will have to file an I-601 and and I-212 because of the ignored voluntary departure... At least he didn't enter w/ fraudulent documents like my hubby- that adds a whole other level of ugly to the case.

Vienna is tough- you will have to put a good case together- but it is do-able (I am living with my husband and his new legal status in the US)

I AM SO HAPPY FOR YOU AND YOUR FAMILY I KNOW I HAVE A LONG JOURNEY AND JUST THINKING ABOUT IT IS REALLY DEPRESSING TO ME... DO YOU KNOW WHAT MAKES A GREAT I-601 EXTREME HARDSHIP LETTER OR FILE WHAT ARE THE BEST THINGS TO SUBMIT. I WOULD LIEK TO START ON IT NOW SO WHEN THE TIME COME I COULD HAVE IT DONE AND JUST GIVE IT TO MY HUSBAND IN HIS BIRTH COUNTRY WHEN HE GOES FOR HIS INTERVIEW HOPEFULLY. I WAS WONDERING WHERE I COULD FINE THE VIENNE THREAD SINCE I AM NEW TO THE WEBSITE. THANKS SOOO MUCH ALL FOR SUCH MY WELCOME AND HELP.:dunno::confused1::pullinghair:

This is the link to all of the approved I-601 letters you should review. Mine is in there- since it was fraud/misrep waiver you should read it... and Dana's as well (recent approvals from Vienna)... see what ideas it gives you for your own letter.
