If I start all the proceedings and filings and when the day comes for my husband to go back to his country...I don't know what will happen to our children and myself. He is the main provider for our family. I would certainly lose our home and much more if he went away, and yet he is not suppose to work illegally so I can't use that as a hardship, can I?
I have half a mind to not file for him because of the backlash of what it would do to our family, and sheesh...I would really miss him.

His working illegally is pardon because he's married to a USC. You can most definitely use that in your HSL. Is he going to CDJ? If so I've heard the pilot program is a permanent fixture so he should be able to come right back after his infopass. Hubby and I did medical and both appointments with in 3days.

"Unfortunately," he's from Ecuador, so he won't be able to file through the pilot program, and he'll have to wait outside the U.S. for some period of time, there is really no way around that. One hope would be that in another year or so the pilot program would be instituted in Consulates across the world, considering how successful its been in CDJ.
You can definitely use his the fact that he provides for you as hardship, but the process of adjudicating the waiver and the hardship claims is what will keep him out of the country.
It's definitely a very difficult financial stress. We planned ahead for the time he wouldn't be here, and the fact that we have some of his family members here living with us (and paying rent) helped a ton. I wouldn't shy away from filing yet, think about what options you have as far as saving in advance, maybe finding some housemates, or renting your house while you go to Ecuador to stay with him... or you could move to the Mexican border, you could work in El Paso, and he could stay home and be the house-dad for a year. :)
Anyway, just some random thoughts, but at least you have time to plan ahead.

Wow, I thought for sure it would be held against him working here illegally (hence this is why this site and people are amazing)! I have been giving it all a lot of serious thought, the pros and cons, if you will. We don't have much family or friends. Where we live I think my husband is one in about 20 hispanics in the area (that includes the one mexican restaurant in town). The police come in with immigration and do raids on the few that are here, almost every 6 months. It's terrible. I've helped a few who were homeless with nothing but their shirts on their backs.
I am not familiar with all the terms (abreviations) you all are using. This is really my first day learning anything signifigant.
Thanks so much!
