Ok well im still wanting to get info on how to get her a citizen by marriage, shes from el salvador, and snuck into the US, but beyond that for now, would it hurt me if i was to try and get her a citizen, that i have 2 dui's, and some other offenses, none of which are felonies? All charges are related to alcohol, public intox, contributing to a minor, dui, and disordaly conduct, now that you all know my bad side, lol, would this effect me from getting her citizenship?
Your criminal record should not affect her. She will be the one they do a background check on....not you.

A fiance visa (I-129f) goes somewhat faster than a spousal visa. I filed for my fiance in January and already have our approval to go to Mexico.

well that was a good read, and gave me some light, but i still dont understand if we were to get married now what would i file? and bottom line would she have to go back to her country in order for her to become a US citizen? im sorry for asking so many questions i just really want her to be able to live and see the things that alot of us can, its just hard now she cant fly or really travel to far without being scared... Thanks
If you were married, you would either file the I-130 or the I-129f. Although the I-129f is a little faster, I think it's more work in the long run...and it costs more. To me, the benefits don't outweigh the costs.
When she came to the U.S. she came illegally correct? When was that? How many times has she came to the U.S. illegally?

she has only came to the US 1 time, yes snuck in and she has been here now for like 3 years about!!!!

Hi Camera Shy -
Take a few steps back. If she is unlawfully present right now the first step is a visa and permanent residency, then a few years later she can apply for citizenship.
Your record will not affect her, but if she has any criminal record that could be an issue.
As far as the process, you can either marry first or file as fiances. There are slightly different processes but either way will require her to return to El Salvador and for you to file a waiver for her unlawful presence.
Start reading the sticky posts and researching what you need to do to start...
Then it sounds like she will have to go back to El Salvador. You can get married here though and submit all the paperwork. Then she'll be scheduled for a visa interview in El Salvador. After her visa interview she will submit a waiver, which basically is a letter and backup documentation stating why it will be an extreme hardship for you if she can't come back to the U.S. Then she'll have to wait in El Salvador until she gets a response. I don't know what the wait time is down there. Check out the I-601 All other countries section.

It's unlikely to be over a year, but I can't think of anyone off hand who has filed through El Salvador. It could be 6 months to a year...
