Hi my name is John, but a lot of my friends call me big country. I want to first thank all of the people that contribute to this site. I have only just started reviewing all of the information available but it seems great. So a little bit about my situation.

I have been dating a Mexican girl named Sandy for 8 months now. Everything is going really well and we have started to think about a future together. Heck, I have already learned to speak Spanish fairly well and am taking weekly Salsa lessons.

Sandy arrived here illegally with her parents when she was five. Her brother who was born here and serves in the military is a USC. Her mother is also legal because of being vouched by her son. Her father is not because of legal issues.

Sandy received some type of working papers when she was 8, thus she has a social security card, current drivers license (which is about to expire) and pays taxes.

I was wandering how to start this whole mess. I was reading about the I-129 form, will that work for my situation. What do you recommend.

Actually it is an I-129F, and you need to be engaged first...

Others will prompt about whether your GF has left the country after coming as a child, but they know much more about those things than I do...

wELCOME.... You should post your question on the 601 mexico and you will get lost of help. like ibm said they are much better at it than me too....
be sure to post when she came in and if she went out of the states at any time. you will need that for them to answer

Basically, as long as your girlfriend has not left or re-entered the U.S. at any time during her life here, nor has any criminal record, she should be eligible for a waiver of inadmissibility for the unlawful presence.

You can go the fiance visa route, but eventually she will have to go to Ciudad Juarez for her interview.. assuming things stay as they are now, she will be denied the visa but then allowed to submit a waiver (I-601) to be supported by an argument and evidence for extreme hardship to you, the USC relative. You can read about those letters in the I-601 Mexico forum, there are tons of examples there, and the CDJ consulate has a very high approval rate.

In CDJ your waiver will be immediately adjudicated, and likely approved. Most people are only spending a week or two in Mexico/CDJ.

As elvia said, you might want to post a little more detailed information in the 601 forum.

Do you know if anyone ever filed any type of petition for her previously? Such as the brother, or for work (even though she wasn't eligible)?
