View Full Version : Criminal Conviction in Mexico

My fiance EWI from Mexico 2 years ago. When he was in Mexico he was wrongfully convicted of theft and served 4 years in prison. We have been told by one immigration attorney that because he served more than 1 year in prison this makes him permanently inadmissible to the U.S. and ineligible for any waivers. Other immigration attorneys have said he may be eligible for a waiver. I have reviewed the immigration laws but can't find information about the effect of criminal convictions in another country on immigration. Does anyone know the real deal?

Welcome Pargo. A good person for you to converse with is Mzswing, I'm not sure if she has re-registered yet, and I know that her husband recently arrived in the U.S., so she probably won't be around as much....
I would recommend you consult with Laurel Scott, visacentral.net, or attend her free chat there at 11:00 am central time on a Wednesday. Laurel is very experienced with I-601 waivers.
If I remember Mzswing's husband's case accurately, he was convicted of something like manslaughter, not sure if he spent time in jail, but he was involved in a a fatal accident that wasn't really his fault. He qualified for the waiver, but had never EWI, they met in Mexico. If your husband qualifies for the waiver, he would not likely be eligible for the pilot program (which is how many people have gotten very fast approvals lately through Ciudad Juarez) so he woul remain in Mexico for 6-12 months waiting for waiver processing.
