I was deported six years ago, because I received an overpayment from the Social Security Administration for my daughter whom is disabled. I was charged with Theft and soon after my deportation the charges were disposed.

Its has been six years and my daugther is facing extreme and unusual hardship. She has not been able to attend to school since we arrived, there are no programs for children with disabilities (Down syndrome), there are no medical facilities nor appropriate medical care for her, no insurance will ever accept her because pre-existing conditions. She has a heart condition, tyroids problems and some other medical complications but we are concern mainly of her heart. She will be 16 years old next month.

My other son attended an american like school here for the last 4 years but because of changes on the school regulations he was not accepted back, so now he can not attend school because the school is not acreddited in the country (only in USA) so he can not attend school either.

My question is, how can I begin to try to return legally to the US? given the charges of theft, misrepresentation and working without permit.

Any advise is greatly appreciate it.

Well I like to share an uodate in our story:

Recently my USC daugther was referred to a US Doctor for a medical check up, it seems that she may need another open heart surgery, so we did everything to have my wife and her travel to the US. In the midtime my USC son was robbed while he was walking to church (which is only few blocks from home) we assumed that the people whom robbed him got some info out of his phone and started to stalked us, then we received some dangerous phone calls in whcih the caller was threaten to kill my US children if we do not pay him a large amount of money. We went to the US Embassy to report such incident and they advised to remove our son, I like to add that the calls were pretty serious since the caller has private inforation of where we live and work and some other details that showed they were serious, so we paid some of the money to buy some time, my family left recently and are now in the US.

If someone can guide me I will greatly appreciate it. My wife wants to fight in thye USA so we can immigrate legally I was deported, my daugther faces extreme and unusual hardhip here in Guatemala, given her heart condition, tyroids and down syndrome.

We are now also facing an extortion in which both of my children are in dander.

Maybe you can contact the Catholic Social Services or another non profit agency in the city or state that you lived in in the U.S. so they can help you. That is an awful situation and I'm so sorry you have to go through that.

I'm not sure, but would a humanitarian visa work for you? Maybe asylum? Keep asking around in the forum. Maybe somebody can provide more information.
