My husband is in jail, and will be handed directly to INS after his 6 month term is over. How can I know when he will see the immigration judge? I can't afford a lawyer, but I can afford to buy my husband a plane ticket home if I can persuade the judge to grant him a voluntary departure. I need to BE there in order to do that... does anyone know if the EWI's spouse is even allowed to be there? How can I even find out where he is?

Corazoncita, I don't know the answer to your question, but I just wanted to wish you good luck. I hope you can find the answer so you can request voluntary departure for your husband. I'm so sorry you are going through this...

You don't know what jail they're holding your husband in? I'm pretty good at researching and finding answers but I'll need more details. First, just let me know if you know where you husband is right now and we'll go from there.

I'm sorry that you are going through this. I don't know much about court proceedings after jail time, but I know when my husband was given a notice to appear (not after jail), I was able to be in court with him. I was not, however, given any opportunity to speak. He was called to the front and the judge just asked him a few questions and then decided to grant him voluntary departure. Sorry I am not more helpful. By the way, your pictures brighten my day every time I see them.:)

Well, right now he is at Craven Correctional in Vanceboro, NC. This is just a temporary processing center... he believes he will be moved to McCain correctional hospital in McCain, NC. This is mostly for inmates that need medical attention, but a third of the population is healthy inmates who are used for maintenance, cooking, landscaping, etc. He is about 90% sure he is going there next week... it is a minimum security prison. He had a pretty small offense in comparison with most of the other inmates. On the NC Dept. of Corrections website, you can look up an inmate and his charges... on my husbands page, it says he has a detainer-- meaning there is a third party who has control of him upon his release (in this case, INS). Recently I have talked to a lot of the prisons in NC, and asked hypothetically if they call INS on inmates depending on their charges-- and they said they absolutely call INS every time no matter what if they don't have legal status in the country, regardless of the crime. Our criminal lawyer's paralegal (this is also an immigration law office) says that INS must come pick him up within the 48 hours preceding his release. If they fail to do so, they must let the inmate go free.

I am sorry, but I don't have any experience with being in jail for a period of time before a deportation is going to occur, but when my husband was deported last January I had no idea where he was! When I stop and think about this it makes me so mad not knowing where he was!
He was deported on a Tuesday morning and was taken to the local INS. About four hours later he called from the INS and asked if I knew what was going on because he was not told anything. I had been in contact with our attorney and that was it. Later that day I found out through our attorney that he had been transferred to a jail. He stayed at INS the whole day before being transferred. Our phone company will not allow collect calls so finally by Saturday I was able to talk to him. I had to call an 800 # and give them my credit card # and was able to set up payment plans. We talked Saturday & Sunday. It felt so good to talk to him since we had not talked since Tuesday morning. Anyway, Monday came and I did not hear from him so I called my attorney and he said he does not know where he was transferred. Then Tuesday came and I still had not talked to him. Then all of a sudden about 10:00 at night on Tuesday my husbands friend called to tell me that he just got a call from my husband and he was in Mx. I was devested! They did not even let him call me to tell me this. I finally got to talk to my husband Wed. night when he got to his moms. He told me he tried to call me Tues. night, but the cell phone did not work. He had time for just one more quick call and luckily he got through to his friend. My husband told me when he left the first Jail he had no idea where he was going. They drove him to another facility and thought he was going to be able to go in front of the judge. Next thing he knew he was on a plane and that was it.

my3helpers: First, I am SO sorry you had to go through that! It sounds devastating! I mean, at least I have time to prepare myself for the fact that my husband will be deported-- with you, there was no warning, and that had to be so hard on you! :bluesad:
My hope (in this particular case) is that they will deport my husband quickly, if in fact the don't give him the chance for voluntary departure. My husband is from Honduras, so they don't have near as many flights out as they do for Mexicans. He will have to wait in an INS jail-- for up to six months, I've heard-- until they can get enough Central Americans to fly a plane back. I just wish they'd fly him immediately... the sooner he gets back to Honduras, the sooner we can have the appoinment and file our I-601. I still would much rather be granted a voluntary departure-- that way I don't have to pay to file an I-212 as well.

corazoncita, I think the hardest part of it all was that I had just found out 3 days prior that I was pregnant, but I think the pregnancy has kept me calm because I know I cannot just give up! Now we are finally at the part where we are just waiting for an interview.
I pray that he will get a voluntary departure as well. I never realized they would keep some one here for that long! My husband told me that they had shipments whenever they had enough people as well, but it was usually every single Tuesday.

my3helpers: Congratulations on the pregnancy!!! When are you due? Probably Sept. or Oct., right??? WOW! Do you know if it's a boy or girl? I'm soooo sorry your hubby won't get to be there :( :( :( I'm sure he or she will be beautiful, and your husband will get to come back a legal man and be just the best daddy he can be. I understand how you feel... We filled out our I-130 back in May of 2006, but right after that, we found out I was pregnant. I dreaded the thought that he wouldn't get to be there when his first child was born. Even though he is in jail now, and I won't get to see him for 2 years, I would make that same decision 20 times over again. I will pray for your family, hun.
Chula: Wow! He got a job FAST!!! Isn't it great to have nothing to be ashamed of or lie about?? REAL papers, a REAL SS#.... you have to be on cloud nine right now! I remember you saying that you were on KMBC9 news talking about your hubby and immigration reform. I sure wish I could have seen it-- or better yet, if I had lived back in KC at the time, I woulda been RIGHT up there with ya. When my husband gets back, we will have to plan to go out to dinner or something! He doesn't have any friends or family here-- they all live in NC. I'm sure he would be delighted to meet your husband. :)

Anyway of course when hubby gets here we can have cook outs and such see Ellie's hubby is the grill cooker so yea the more the merrier!!!!
