View Full Version : Are waivers only for overstays??????

Does anyone knows if anyone has ever been approve for a waiver for a criminal offense?? For those who dont know our story, my boyfriend was charged for aggravated assault wich he plea not guilty,(wrong place at wrong time) now he was given voluntary departure so he just went back to Macedonia,now the criminal case its still pending he was offered now to pay some restitution money and case dismiss, we know he will come out guilty to a lesser charge we dont know yet, anyways one good lawyer told me if he comes out guilty he does not have a chance, another good one its looking in to it and another one told me he should be ok as long as we could somehow show his innocence on the waiver letter, What do you think, does any one has an idea, cause I know that if you have two charges of agravated charges then you are innadmisible, but I dont understand cause he even got the voluntary departure cause the imm judge felt he was innocent and did not even bother to wait for the criminal case to be done he even said those chrges could be drop and he's never been in trouble with the law before this is his first arrest and first offense and we could prove his innocence but he is not here and anyways things are not working on our favor at all, it was either plea guilty or go to trial wheter he was here or not and he was being detain so he was gonna be deported instead so he prefered the voluntary now and hope they drop the charges but we dont think thats gonna happen, but still does anyone knows about a case like ours, please let me know... :shy:thanks..

No, there are all kind of waiver, I am not familiar with the Macedonia consulate process, but in Mexico if you have criminal background or deportation you usually need 2 waivers, at the time of your interview. Good luck

My hubbys waiver was for a criminal offense (mischief). I think that the older and less severe the offense the better chances the waiver has. My hubbys offense was almost 20 years ago, so that was a big plus. He was also able to show the changes he had made in his life with letters from his boss and local business owners. He also included a letter about his offense, and admitted to what he had done and how his life had changed since that time.

Yes, the I-601 is for criminal issues as well, but as Kenaly said, the older and less severe the offense the better. If he is convicted of this violent charge (from last year, right?) it's going to be extremely difficult to overcome.
