For the HSL letter and waiver packet, I know I need to show extreme financial hardship. This would include, I imagine, records of my mortgage statements, balances on student and car loans, credit card debt, info on my salary and benefits and what I'd lose if I were to move to Peru....

For finances, do I also need to show my hubby's name on bills, bank accounts, etc? Do we have to have joint bank accounts or do separate bank accounts work too? The house was mine and all the utilities were in my name when we got married. Changing things over to his name, I've been told I have to pay to disconnect and send someone out to reconnect or some such nonsense, which seems like a waste of money. BUT if it will help our immigration situation....

and it won't help his credit either because he doesn't have a SS#, right? or is he building credit with his bills, etc.?

The hardship is yours. These are your bills - technically. I would think that it would cause YOU anguish if you couldn't pay them. We filed for a fiance Visa, but I would think for HSL purposes this could work as a hardship without doing all the name changing. You should be able to add him to your bank accts without any charges.

You do not have to show your hubby’s name on the account.

As for the financial hardship, you also might want to put comprising: $mortgage payment, $cards payment and how much money you can make in your hubby’s country. So, if you pay $1000/month for the mortgage, $500 credit cards and your monthly salary in his country could be max. $300 – here you go your hardship. Also, bare in mind that they can say that credit card payments is not hardship but your poor financial judgment. However, we still included that in our waiver.

The name on the account business is more for showing a "bona fide marriage"...like our lawyer recommended that I put Mario's name on my bank account (which I was able to do AND only have him access it to DEPOSIT money!).

As far as for the waiver, it is hardship on the USC. At that point in the process, you definitely WANT your name on it (mortage, car loan, student loan, personal loans, etc.).

You will also want to look into the possiblity of your ability to even legally live/work in his country. Obviously that would create a HUGE hardship if you couldn't. Also check into minimum wage in the other country and only one income vs. dual (?) income here.

(Sometimes I ramble, but I hope that helps a little)
