View Full Version : Sending in my I-129 today, need help...

I was just curious if on the application for the "Date of Arrival" of my fiance if I should put the last time he arrived since he first came from Mexico to the US in Jan of 99 but then returned in June of 99 to Mexico and came back to the US 2 weeks later. So should I use the original entry date or the June date? Also, is it a good idea to submit our kids birth certificates as proof of us meeting and a copy of our marriage license (no, we are not married yet).

yes on the birth certs.
don't know about the dates--they're going to have to know eventually about the two entries and you have to be super clear that they were only 2 weeks apart to prove that he didn't accumulate more than 1 year before EWI again.
about the marriage cert--i'm assuming you're planning on getting married pretty soon if you have it--i know here they were only valid for 6 months after the date of issue. first, i'd say don't send it--it would confuse them. second, are you planning on getting married during the process? i don't think you should do that. you should really wait until he is back here after you file the i-601 and get approved. the process goes MUCH faster filing as fiances (see misantito's timeline) plus if you get married in the middle of it i'm not sure how that will affect the case. just my two cents.
