When we were applying for the waiver we were told that all Ukrainian case are now going thru Kiev. However, because originally I went throw Poland, Warsaw I had a choice to decide where to go. I am not sure is it because my case was pending there or what else.

What I would suggest you to do – is for your husband to email Warsaw (you can find their email on the web) and ask that question. Warsaw usually replies to the US CITIZENS in 7-10 days (that is why better if your hubby would email).
That would give you a written evidence (if you need one) that you can or cannot go throw Warsaw.

One more thing: my visa to Poland was denied in 2005 based on overstay in the US. It took us 3 month and trip to Washington, DC so Polish Embassy would change their opinion. It was before Poland started to be on the road to the European Union.
It might be difficult for you to get a visa to go to Poland. So go to the Ukraine, Kiev might be easier choice and you are 100% allowed to go there and apply for the wavier.

Good luck
