Hi Guys,
I am in a bit of a dilema here. (as everyone else).
My wife and i are both from the U.K.
I have been in the U.S since 1992 as an LPR.
Got married to my wife in 1999 who is also from England.
She came to the U.S in 1999 and overstayed her visa for 4 long years.
we left the U.S because we had financial problems in oct 2004. (Big frigin mistake)
Whilst she was in the U.S we had two Children who are U.S.C.
As soon as we left the U.S in 2004 we got a letter from ins telling us we were approved. (now we had to go through N.V.C) as we had left the country.
She finally had her interview in Jan 2007 only to find out that she had been denied. (on grounds of overstaying).
We had to file a I601 Waiver and was also denied because i could not show enough hardship (being away from loved ones is hardship but seperation does not count) !!!!!! go figure.
Anyway, I have become a U.S.C. now and want to find out how i can get my wife and my beloved kiddies here A.S.A.P.
Oh, and before i forget the wife and i had another child in England on 26 august. He is 2 now.
Please tell me what i must do.

1) refile I130 ?
