I'm asking for my Brother, he meet someone online that is a british citizen, they communicated for a year or so and she came to the US last February 2007. They lived together from feb.07 until dec.07 (they took a vacation to mexico to get her visa to renewed in june 07, since she could only be here on her visa for 6 mos.). Well come to find out they were married here(US) in Feb 2007, unfortunatley my brother just told us(family) this feb 08(but her mother was their witness for the court wedding in 2/07) which of course we were upset. He had been petioning for her since Feb 07 while she was in the states. I believe immigration informed her to go back to england and petition from there, now would she need to petition to come to the US to the british goverment or ours? Any ideas on how to get her permission to come to the US or did they do this all wrong where it may have harmed their chances.

Thanks,

SES

Your brother needs to start the process sending I-130 or I-129 to NVC in US and wait for an approval. Than she will have an appt. in British consulate. I think this can take 4-8 months but I am not sure. What your brother did so far? What kind of petition he made?

that is basically how it goes... the sooner you file the quicker it is!
