View Full Version : Scared about being ineligible for the waiver

My hubby started to visit this site more often and now he is getting scared about me leaving: what happened if you are ineligible for the waiver?

I am trying to make an appointment with Heather since we will be in LA next month for a weekend, so my husband can ask her all the questions he has (poor Heather lol).

Let me explain my WHOLE situation:

In November 2000, my uncle (who is an USC and veteran) sent me an invitation to come visit him here (I just turned 18) I went to the US Embassy in Peru and request a nonimmigrant visa (tourist), and the lady there (a completely *****) said no! At that moment I had no intention of leaving Peru, I was going to college and having a good life. Well, 3 months later my parents informed me that they couldnt the expenses for my education anymore :( I decided to come here ilegally by February of 2001 and I got here on May 2001crossing the border and made it in the first try (worst experience ever so far) I've been here since then, working and going to school with the same SSN (not mine of course) and I have credit cards, bank accounts, etc with it. I also got a car loan 3 years ago, but its paid full already. I dont remember ever saying that I was an USC, I always check :Permanent Resident (Dios mediante one day). I never got any USC benefit since I am not one how could I?

One more thing, here at work we just started to verify SSN (guess who is doing the verifications LOL) Anyways, I check the SSN I am using and it says that person is dead :( ....

Well from what I'm seeing you should be eligible! I'm sure more people will chime in!

Hello Chalakita,

well im not very experienced in this site, but so far i think you are able to qualify for a waiver since you only EWI once and have been here ever since. The illegal employment is waived when married to a USC. the only problem might be if the persons SS you are using was a USC but not sure if that affects the waiver... good luck :)

Chalakita: just my opinion, if you never had any problem with the number just cancel everthing.

I didnt know this number was someone's else number, I thought they made up. I am not sure if the person was an USC or not. Now I am scared!

I do have a Driver Liscense, But I never gave this SSN. They didnt request a SSN.

I think that's something you should ask Laurel (visacentral.net) on her chat next Wednesday or maybe do a consultation over the phone and see what she says since she has so much experience with the waivers she should be able to tell you if you are eligible or not. Good luck !!

Thanks everyone - I'll ask laurel next week. Adeildo, in your first interview? Did they ask you how you got your liscence? or what SSN you were using here?

chalakita: no, they din't, I have driver's license, it's the same way you have without ssc, I never used any ssc, I'm not sore but I think they never do question about traffic violations, smoll things like that.

Hi I know how you guys must feel cause we are very scared also about the waiver cause even Laurel Scott told me that he is 99.9% not elegible for the waiver cause of his criminal case, and he already left the country and the criminal case its still pendind, so we are kind of loosing hope for the waiver and he also has the 10yr bar cause of his over stay, but I dont think you guys should have a problem, just get very good advise before you do anything and be carefull with some lawyers cause the one we had for immigration did not know ****, good luck...and Ill keep you in my prayers:thumbup:

Seasun I am so so sorry about your situation, please dont give up! I take your advise with the lawyers, I went to one that didnt know s%#&! and just made me waste my time and my money, but thank God I found I2US and here everyone knows a lot and they are always happy to help (like Laurafern, Marie, Lucky, Angela, Billchris, Jsierra, Task etc etc). I'll pray for you and your husband :)
