My cousin, Phil, is still in his home country. His brother who is now a US citizen wants to file for him. But Phil was arrested and charged twice in his home country but both cases have been dismissed, he was never convicted. Does this mean that when USCIS does the background check he will not be able to get a green card?

You need to be a little more specific about the charges and the criminal activity involved.

From what he tells me the first charge was for a bad cheque and the second was for a letter he issued to someone stating they were employed at his company when they were not. Both charges were dismissed.
