My cousin, Phil, is still in his home country. His brother who is now a US citizen wants to file for him. But Phil was arrested and charged twice in his home country but both cases have been dismissed, he was never convicted. Does this mean that when USCIS does the background check he will not be able to get a green card?

What were the charges for? What type of crime?

He was charged for petty fraud. Meaning he issued a letter to someone from a company stating that they were employed at a company when in fact the person was not.

any ideas?
