I had this consultation w/immigration lawyer few weeks ago. I told the lawyer that I am married to USC, and we intend to file I-130, however, I know I will have a challenge w/my case, so that's why I came to see him to get some advice. B4 I got married to USC (in Canada) I was denied for work visa at POE. We talked a bit about my case, and he SUGGESTED I TRAVEL TO US and do AOS there. Let me ask you something... If I do that, I either
HAVE TO ADMIT HONESTELLY the purpose of my trip, which is AOS, for which if am not mistaken, my entry will be denied
OR
I state I am going to visit, like this lawyer said "just say you are going shopping to Buffalo" (a lot of Torontonians do that often), and when get to your husband and AOS. That was his suggestion. Correct me if I am wrong, but that would be fraud, because I would lie about my trip purpose.

Yeah, I would not follow his advise, because it's sketchy and could end up banning you for life. Ugh, you would think people with a law degree would be better about these things... You might want to do do a consultation with another lawyer, because it sounds like you're not getting very good advise. Best of luck to you!

Well, may he burn in hell..he he:) No, no he is not doing my paperwork! Me and my husband are working on submiting I-130 on our own, I do believe I will need a waiver I-601 so that's when we will get an attorney. Will need your help to choose a very competent one, I can't be very trusting after one bad experience w/lawyer, and now this one telling me "go shopping":)

I assume you are in Canada now? Why do you believe you need to file a I-601? You said you were denied a for a work visa, what was the reason for that? Do you have any previous overstays or EWI?

Discoviking:that's another story about another lawyer. I was in US at the time whe he was preparing a job agreement for TN. Before I left to Canada I specifically asked him if they would know when I entered US (by car), and he said "there is no way for them to know because canadians do need visa". When applying for TN at the airport I lied to officer about my lengh of stay in US, so that's misrep. I also overstayed by 187 days, you would think a lawyer would urge you to leave US before accumulating 180 days of oversray, but nooo, he did not care I guess. I was alowed to withdraw my application for TN, and there are no official misrep or overstay charges, but it is on my record, and they will charge me at the consulate when I go for K3 or IV.

i really think that most of the time, that if you are not with a group of immigration lawyers that are $$$ and well known,, it is better off to post advice and stuff here, coz, based on our experience, and the stuff we've seen in other places it is like... we have a civil opinion + experience... therefore we can give you knowhow costumer info in the matter!

so you can investigate further more the legal advices that has been given to you, and please do not forget, there are plenty of fools out there performing immigration related issues without being certified!....

Perhaps he was thinking that you would attempt to adjust your status in the US because you entered on a valid visa and you are married to a USC. In this situation, overstays on legal entries are forgiven via the relationship with the USC. At this point, you are most likely facing charges of misrepresentation (at least one, maybe two due to your B visa situation) as well as illegal presence. Do you have a new lawyer?

I consulted Laurel Scott, I am hoping she will take my case, I just CAN'T afford bad judgement anymore, no matter if it's on my side, or coming form lawyer.

I have not used Laurel or any other immigration lawyer for that matter, but based on other members experience amd recommendations, I'd say you will be in good hands with Laurel if she takes your case.

I am sorry to hear the situation you are in, but we are here to help you, too. Based on what you posted about the earlier situation, I agree that you have overstay and possible misrepresentation, so it looks to me like you will need to file a waiver. Good luck!
