On the application/instructions for I-765 it states that a person who has filed a I-485 AOS and it is pending with a receipt can file a I-765 EAD.

7. EAD Applicants Who Have Filed for Adjustmentof Status.
A. Adjustment Applicant--(c)(9). File your EADapplication with a copy of the receipt notice or otherevidence that your Form I-485, Application forPermanent Residence or Adjust Status, is pending.You may file Form I-765 together with your FormI-485.

Has anyone done this before? How did it turn out?

We have filed a I-130 and a I-485 and have NOA1s on both...and are in DOJ removal proceedings...

It would help out so much with hubby's stress level if he could renew his EAD...

You can renew your EAD as long as the I-485 is pending. Review the I-765 instructions as to where to file. Generally, you file where you filed the adjustment.

We filed all forms at the same time. You get the EAD and you are allowed to work in the US while they are reviewing your application.

Jveli i presently have a friend who is in removal proceedings together with me and he got his EAD card and just like your husband he had one before but only had to renew it..hope that helps.

Well you guys have confirmed what I thought I was reading...but something keeps nagging at me about something the lawyer said about hubby's case and why we would wait until later. I cannot remember if it is because he doesn't qualify or if it is a strategy thing...I will have to properly word an email and shoot it out to him.

The problem is...hubby is dealing with a work place bully and he has gone to his supervisor a few times, and this guy gets spoken to, and of course it stops for a while and than he starts up again...and my hubby is not the only target...but what makes me sick is this guy is Puerto Rican and talks crap about other Spanish people and their status. His job is being excruciatingly nice by continuing to employ him because they know he had an EAD before and they know we have petitions pending...but if he ends up losing this job and cannot get another one...or has to work under the table we are screwed.
