Firstly I am brand new to this site, so exuse me if I seem clueless. I was referred by a friend from work, as immigration is stressing the heck out of both of our lives.
I know this is a little long of a post but i would realllly appreciate if anybody could give me some hope!
My husband came from Venezuela on a tourist visa in December 2005. We met in April 2006 and got married in December 2006. (He stayed past his 6 month limit obviously in hopes of getting residency.)
We filed in February 2007 for work authorization and ajustment of status based on marraige(with a horrible lawyer who really did nothing but rob us:dunno:.) He got his EAD after about 89 days, and our interview which was last June.
So our interview went alright, they officer removed my husband from the room and then she proceeded to question me about why we got married and if he ever asked me to marry him just to get residency. Honestly, I was not expecting those questions at all so I think I came off nervous/suspicious to her. Also we're very young, we were both just 20 @ time of interview.
I had recently returned from Venezuela where I met all my inlaws (without my husband, b/c he cannot leave the country until he has a GC) and the cranky old woman officer seemed happier when looking at the pictures. When we left she had a smile but didn't give us any hopefull words.
10 months later, we're still waiting for his approval for AOS. Its pretty stressful b/c my husband can't get a licence, his EAD is about to expire, and he can't go with me to Venezuela this month for his mom's huge 50th birthday party.
A few months ago we made an Infopass appointment to check status and they said it was in final review. The lady there said it was a "work load" issue?
I called Immigration a few weeks ago to see what was up, talked to a really nice lady who said our case should have been approved by now and that she'd send a request for service to the officer we had our interview with and hopefully we'll get a letter in a month to say what's taking so long.
Anyway I've had 2 friends a little bit older go in and get their green cards on the spot, so I'm just frustrated and worried..
Can anybody give me hope or let me know if we should re-file for his work authorization?? His employer will give him about a month to get it if they find out it expired.
