not sure where to post this but trying to figure out a solution
My brother in law is 15. he will be turning 16 in november. His parents brought him to the u s illegal when he was 2 along with my husband, is there anything that can be done for him to legalize him. could i adopt him, he also has an uncle who is a usc can he adopt him? Should he leave the country before his days start counting towards illegal status, the only problem if he leaves is that he is still in high school he is gonna be a junior? what should he do? any advise or opinion is appreciated! does anyone here know of a similar situation? does anyone know of a lawyer that may handle this type of issue. I was thinking laurel scott but she handles i-601's and such.
please help i have like 2months to figure it if i'm gonna help him!
I was also wondering if a child under 16 gets caught at the border anyone know if they fingerprint them and if they do does that count against them? what if it's not their choice? I'm just asking because my husband says that it's possible when he crossed over at 7 they got onto him and denied him entry, does this count?

Great question....
anything under the age of 18 will not count against him...so you are right to weigh all of the options now and see if you can figure out a way to do this.

so he had to try 2times but once he got through he stayed and never went back

The only way I see this happening is if the US uncle adopts him as his son and then petitions for him. Unless he is getting married and he seems a little young for that right now.

thats what i thought too but i also dont want to risk having him deported or denied a visa and then he's stuck in mexico
Would he be deported or denied?

If the Uncle adopts him he will have to petition for him as a son, but I am not fimiliar with that process yet because I have not done it yet. I have a stepson, but we have not filed for him yet.

I forgot my brother in law is 16 already. I confused the year he was born, for now i think he is going to wait because he wants graduate from high school which is understandable. I just hope that by the time he gets ready to file the pilot program will still be around. He has a steady girlfriend of 2 yrs but they are just to young for marriage at this point in time.

This would be a good question for Laurel's chat. If the uncle adopted him before he was 18 and therefore before any unlawful presence accumulated, would he have to leave the U.S. still for a consular interview? How would that work if he was still a minor? If he eventually marries this or another USC girlfriend, that would probably be easiest, if the pilot program is still around and there isn't any major step-up in enforcement between now and then...

It would be wonderful if this act were to happen but with the current government in place it's hard to look upon them for solutions. They can't even seem to agree on the simplest debates but it woud be wonderful if the dream act were to happen.

I had actually been wondering the same thing. I also have a nephew that was brought here when he was 3 yrs old. One of his uncles is a U.S. citizen and would adopt him if he could in order to make him legal. But I was thinking....wouldn't that look really suspicious that his uncle adopted him when he has a mom that has always taken care of him? I would just hate for them to go through all the trouble of getting him adopted and everything and then have immigration suspect that the whole adoption was just to get him legalized.
