American Families United is trying to organize a conference call with a Tax person and an Immigration attorney to determine if 'married filing separately" can get mixed status families a stimulus check without jeapordizing the appearance of thier 'legitimate marriage" for immigration officials.

Are you eligible? The vast majority of people who file a 2007 income tax return qualify, and many who don't regularly file a tax return may qualify as well. You're eligible if you have a valid Social Security Number (SSN), can't be claimed as a dependent on a tax return and have either an income tax liability or "qualifying income" of at least $3,000. Qualifying income includes any combination of earned income and certain benefits from Social Security, Veterans Affairs or Railroad Retirement. Additional information is below, and a full legal description is available in Revenue Procedure 2008-21.

Both people listed on a "married filing jointly" return must have valid SSNs to qualify for the payment — if only one has a valid SSN, neither can receive the payment.

Can you use an ITIN instead of an SSN? Taxpayers with an Individual Taxpayer Identification Number (ITIN) instead of an SSN are not eligible to receive a stimulus payment. Both people listed on a "married filing jointly" return must have valid SSNs to qualify for the payment — if only one has a valid SSN, neither can receive the payment

My opinion is that this is very discriminatory for many of you and your children. I wish you all the best. We can all use the money.

I know...I believe that this is not right! If anything, I do believe that we should at least be able to receive the single's rate then. We are all doing the right thing and filing the way we should, and we end up getting 'penalized'.

On our taxes filed this year, I ended up filing jointly. If I filed seperatly, I would have got less back, but I would have been able to get the stimules package.

Which taken together, would have equaled what I got for filing jointly...so for me us at least, 6 of 1 half dozen of the other.

All you ever hear about is how illegal immigrants don't pay taxes, and yet they do! You hear about the drain they cause on the funds in the US, and yet the government will be keeping the stimulus checks from those of us who are citizens married to people without SS#s. That sucks, punishing us for filing our taxes correctly.

I don't understand why they don't at the very least give the stimulus to the USCs in the family.

I dont think they are trying very hard to stimulate the economy if they wont give the money to ALLL USC and their children.

I filed married filing separate b/c my husband is out of the country...does this mean I dont get stimulus check...I'm confused.

I think they are still trying to find out if you will or not!? Its not clearly stated... I was under the impression you wont get it, but I guess its still up in the air.
