View Full Version : New here and lots of questions!! (Fiance Visa)

Hi there,

My name is Tara (27), I currently live in Canada (Canadian citizen). My finace is a US citizen and we met in May 2007. I am currently 8 months pregnant with our child (found out I was pregnant in September 2007). I also have a 5 year old son with no biological father in the picture.

We have decided to apply for the fiance visa for my son and I to move and live in the US with my fiance. We've been concidering a lot of options, him coming to Canada, getting married first, etc, etc, but we've decided on my son and I moving to the US.

So what do I do now?

I know my fiance has to fill out the initial application and mail it in, but what happens after that? How long does it usually take before we can move to the US? What about the baby, she isn't born yet but would we include her in the application? Will my son be able to attend school in the US once the fiance visa has been approved? So many questions.

Any and all advice would be soooo appreciated!!

Also, I've been reading a lot that we will need to prove our relationship, that we've met in person etc. My son and I do not have passports, so I cannot use that. (I plan on applying for them ASAP). The only thing I really have is digital photos. Well, and the fact that I'm 8 months pregnant with his child. He'll be there for the birth and will sign her birth certificate. But other then that I really don't have anything. I don't save e-mails (didn't think to at the time) he might have cell phone bills, I could check for telephone bills. But that's really all we have. He got a passport recently, but not sure how many times he's used it. We don't fly to see each other, we drive back and fourth. Any advice on this??

welcome! someone here just had her i-129f approved in a little over 2 months. there is no guarantee how long it will take for it to be approved, but obviously, send it off as soon as you can. they'll take it from there. i believe canada schedules fiance appts, not like mexico with the open appt. since you never entered illegally (you didn't, right?) and if you have no criminal record, it should be smooth sailing.

i think there's a place on the form to list children. besides, don't worry about school-even children with undocumented status can attend public school.

You don't need proof of ongoing relationship - you need proof of having met in person in the prior two years (everything is fairly clear in the instructions). Guesstimate 6 months processing for the petition and then check the Canada US consulate sites to see if you kind find out how long K1 interviews are taking to be scheduled. It's either in Montreal or Vancouver depending on where you live if I remember correctly and I suspect it's about a 3 months wait. So I would plan on at least 9 months total, give or take.
