Hello all of you, this is a question from my friend .
She is a citizen from Honduras and went to USA illegally in 2000, 2 years ago she married a guy from Ecuador in USA, the sister of his husband petition for him 10 years ago ( this guy the husband came USA with tourist visa and of course he overstayed) AFTER she married him she was at the same petition with him, 4 months after they got married they have an interview in USa and she got her her permanent residency right away. Now he abuse her physically and threatening( o sea la amenaza ) her to get her satus away. She is worried because at the time she was granted with permanent residency she only was married to him for 4 months eventhough he is not a USC citizen, because they got te paper because of his sistger in law petition.
Well the question is does she have to make the condition of removal after the second year of marriage or not,

What a jerk, I have no idea but someone will chime in. My own opinion she should file a police report stating that this jerk is abusing her and maybe she may present the police report to DHS.

She needs to get a lawyer...and get away from him....She won't lose her residency because of spousal abuse...she can actually keep it!

If I am not mistaken she can file WAVA or something like that. I do not know if it matters since she is already a resident but she needs to get away from him and start documenting it (police reports, pictures if he is physically abusing her, tape record if he is verbally abusing, etc).
