ok, so i don't know when i will have to send in the i-864, but i know that it needs the past 3 years tax returns. i don't know anything about taxes. if i paper-file my taxes this week, am i going to get a tax return for 2007 soon? like, if i had to send the i-864 at the end of april, will i be submitting tax info for 2004, 2005, and 2006 or for 2005, 2006, and 2007?
am i making sense?

I thought they didn't require the past 3 years tax returns anymore?

" (Optional) I have attached photocopies or transcripts of my Federal tax returns for my second and third most recent tax years"
Its optional, but just in case I made my husband request a copy of his taxes for 2005 and 2006.

Jsierra - if you send the I864 in the end of April, for example - you would be sending the most current taxes you filed - meaing 2007. I think (and maybe I am wrong) but if you do your aff of support after the tax deadline on April 15th - you would submit 2007 for sure.
We just sent ours this past week and used my 2006 taxes. I know when we have our interview in CDJ we will have to update the I864 which will then include 2007 ...
It is optional to do the past 3 years now -but you do need to write in your income for the other two. It is just not required to send the actual transcripts from those years, though many still do.
And HOLY COW ... I just saw your ticker when I was re-reading your post and noticed that your I130 was approved today??!?! Congratulations!!!! I know it has been a long 7 months for you. YAY!!!
I just sent mine today and I sent 07, 06, & 05. I just made a copy of the return and sent in a copy of the w-2s.

ok good to know. i was going to request those official transcript things but now i will just copy the w-2 and return.
i have a dumb question. is the "return" the 1040?
Yes (1040), and make sure you send all the additional forms that you may had to file. PS, I didn't send my husband's w-2's, just mine.

oh amber, you know i'm a tax dummy :bounce:...additional forms? do you mean like the w-7? does it matter that this year i am filing jointly? i still make enough by myself, so they'll just subtract his income?

Jsierra: By additional forms, they are talking about the Schedule A, B or any other papers like child care, etc. that you may have filed with your return. They want copies of everything and not just the first 2 pages of the 1040.
If you are interested in getting copies of the tax transcripts, it is easy to get. You just fill out a piece of paper and send it in. Not a big deal at all. We did this just in case -- you know you never know. Better to be prepared for everything if you have time.
You send in copies of tax returns and only your W-2s. Please don't forget your W-2s because you will get a RFE for that if you don't.

Djones - Do you need your W2s for the past three years? or the most recent one only?

Although most people send in 3 years of tax returns and W-2's, this is not necessary. You do have to list your income for the last 3 years but this is voluntary. A majority of us do it just to cover our butts to prove that our income has been consistent or for whatever reason.
But no, this is not a requirement. Only the most recent year is the official requirement.

ok, good to know (not that i know what schedule a and b are, but i'm pretty sure that i don't have them) and i have no kids...i am SO GLAD that i actually know where my w2s and returns for the past 2 years are! i got them done at h&r block and they put it all in a neat little folder...normally i lose stuff really easily. speaking of which, i need to go hunting for my husband's passport for that itin.
