View Full Version : Waiver Sent To Lima Recently, Please Helllp!!!

Hello To All - Brazil/ Lima

I Went To My First Intrview With My Husband And It Was Ok..2 Weeks Later On March 12,2008 I Went To My Second Interviw In Rio And I Handed Them The 601 Waiver + Hard-ship Letter And Docs. My Waiver Was For Being More Them 365 Days Ilegal Presence.
But The Interview Was With The 6' Blue Shirt White Guy. That Treated Like S--t And Made Me Feel Like S--t Too. All His Questions Were Regarding The Marriage And The Affidavitt & His Taxes And My Husband's First Marrage. I Was Firm With My Answers I Did Not Hesitade Or Cryed But, He Wanted Me Too. And He Was Laughing At My Answers At The Biginning, Now I Received An Email From Rio Saying The Waiver Is In Lima Already.

My Question Is, Before I Spoke With The Consul, Another Lady She Took All My Docs With The Letter, She Told Me The Hsl Package Was Too Big, She Only Want The Really Important Things, And She Decide To Only Take The Medical, I Keeped The Economic Part Where My Hubby States His Self Employed, I Also Keeped Letter Form Family, Other Issues About Country, She Told Me The Important Thning Is The Letter And The Medical. And She Also Told Me If I Think Its Important I Should Send To Lima By Myself...
So When I Was Talking To The Consul He Told Me I Dont Need To Send, ...but Now Im Confusing,

1) Are They Trying To Make My Case Worse Without Any Proves???

2) Or This Is Normal???

3) Has Anybody Have The Same Problesm With Rio ???
If Yes, Please Share With Me.

4)has Anybody Used Any Senator Help? I Did Use The Expedite With
My I-130 Witch Was Accepted, But I Dont Know If I Can Use To The
Waiver Too??? Has Anybody Been Done This Way??

5) Also On The Interviw He Was Making Many Notations On The Computer, After We Finished The Interview He Printed Out And Signed And Put Together With My Package...lets Assume He Wroted Many Bad Things About My Case...with This Make Any Difference For Me? Or Its Lima Who Decide ??

I Really Appreciated If Anybody Can Help Me ....

The exact thing happened with our son and DIL. Our lawyer fedx'ed our entire package (about 4" thick to Lima) because they only would take out form and the one letter as well. Our lawyer said that it is too much work for them to have to do and so they tell you you don't need it but you definitely do. So please send a copy of the entire thing to Lima yourself. We never received any emails from Lima saying that they got our waiver from Rio. So that is new to me. I don't know anyone who got that email. Rio told us they had sent all of our paperwork but in fact we found out 2 months later that they were still holding it waiting on another paper that they never told us we needed. Hence another trip to Rio to get that taken care of.

So the answer is definitely yes. Send LIma a copy of everything. Make sure you get a signed receipt for the delivery.

Lima is the one that makes the decision. Rio might make comments on what they think but Lima is the one who ultimately decides.

We did use a longtime friend of ours who is a congressman, to help us when we kept getting the runaround from Rio.

If you have a relationship with an elected official and they are aware of your case and have helped you previously, I don't think it hurts to ask them to make an inquirey.

There are differences of opinion on whether they help or hurt. Our son says that he got much better treatment at the consulate in Rio after our friend started making inquireys.

We didn't have this problem in Rio, but my waiver package was nowhere near 4" thick, maybe an inch or so, all straight to the point with supporting evidence. I have seen many examples here of larger, more elaborate packets than I submitted.

I agree with Pinkpig, send the complete package to Lima yourself. It's your life and it is not worth risking a negative decision by sending less information. The wavier is decided upon by Lima, not Rio.

I am surprised by your treatment in Rio. My fiance was there 4 times from start to finish and they were polite and respectful to her.

I WILL SEND RIGHT NOW THE PACKAGE TO LIMA, THANKS FOR ALL YOUR RESPONSES.

I HAVE ANOTHER QUESTION, IN CASE THEY DENIED (PLEASE GOD HELP US) ...BUT WHAT HAPPEN AFTER DENIED??...
WHAT SHOULD WE DO WITH DENIED..??
CAN WE APPEAL???
AND WE NEED A ATTORNEY FOR THAT?
AND HOW LONG MAY TAKE FOR A RESPONSE???
THATS ANYBODY IN THIS FORUM WHO GOT DENIED AND APPROVED AFTER??
OH MY GOD ...IM SORRY TO ALL OF YOU BUT IM LOSING MYSELF ...THIS PROCESS IS A KILLER!!!

i did my interview four months ego, I din't get enything from the embassy.
