i had a question, which way to go to the US is faster...k1 visa or marriege? im outside of the US due to deportation, and i wanted to kno if it was better to file for fince or get married here and then file for that..thanks!

You will get an interview a bit faster with a fiance visa, but you will need to file 2 waivers....one for illegal presence (I-601) and one for the deportation 212).

It also depends what country you are from Andrea. My understanding is that a K-1 is faster through some consulates (like Mexico) but not others.

Andrea, I'm pretty sure you won't need an I-601 waiver, first because you have no countable illegal presence as far as I understand, and second because even if you did, you were under 18 so it doesn't matter in this case. However, you would need the I-212 waiver for deportation.

Anyway, the main difference globally between filing the K-1 vs. Spouse visa is that with the K-1, you spend a bit more money when you adjust your status in the US (which costs $1040 I believe).

Also, with the K-1 you have the added hassle of doing MORE paperwork (the Adjustment of Status) AFTER you enter the US. Meanwhile with the spouse visa, the Adjustment of Status is taken care of in the process of getting the visa, so once you're in the US, you're finished.

As far as which is faster, I'm not positive. Waivers for Argentina get processed in Lima as far as I understand, so hopefully you can get more info on times for waiver processing there.
