I am 16 years old and I have been deported with my family from the US a few months ago due to have overstayed voluntary departure(had a pending motion to reopen) I have been reading and researching online about not hving a 3/10 bar if I am under 18. Although,I did sign paperwork the day I
was being deported to my country about a 10 year ban and was finger printed.So I am confused..
Just want to know if that is true,then I would be able to go back to the US.

PS:my lawyer told me that perhaps we could ..does anyone know anything?

Hi Andrea! I'm really sorry about your situation. :( I'm not positive about the answers you're looking for, besides the fact that now, due to the deportation, you will probably need a waiver for any visa you apply for to re-enter the US. It's kind of quiet around here on weekends, but eventually one of the more knowledgeable forum members will be around.

It might help to know how your family entered the US, and what month/year. Do you only have one entry into the US? Did any US citizen or permanent resident petition for you to have a visa at any time?

:ditto: Please tell us more, sweetie. This must really suck. From your writing grammar, it seems like you've lived in the US for most of your life. How's Mexico treating you?

I"m really sorry to hear this. I hope you find the help you need. Be strong and try to adjust where you're at. Deportations are serious specially when people sign papers. I'm just telling you because I was around 11 years old when I was deported and I signed too. Good luck.

Thanks for the quick responses!

So in 2001, my aunt, who is a citizen petitioned for us..
But in 2002,we entered the US with a visitors visa, then applied for an Asylum
it was denied...signed a voluntary departure(march 2007), but didnt leave,since we applied to reopen the case in virginia

(we were never illegal [social sec.license,work permit], had a court dates, when we went they would give us another date,which was finally in 2006 and thats when the case was denied and right away our lawyer said that signing voluntary departure was best for us..Later on my father found out that we couldve done somthing else, Thats when he wanted a motion to reopen,since we wanted to go against that lawyer,having a different one.)

After all, we got deported back to Argentina in OCT 2007 (sister and father spent 1 month in detention center)

I wanted to know what i could do to go back,finish highschool,college, etc.

I was reading online that to apply for a waiver you need to show hardship,and stuff like that, however Im not married or anything!
