View Full Version : I-751 removal of conditions (I need reasurance)

I am in the process of removal of conditions and I have sent the request for evidence to my lawyer and he has suggested more information such as Joint tax returns. This is the reply I sent him.

Dear Lawyer,

I hope this isn’t going to be a problem, but D and I file taxes as Married filing separately because he has back child support issues and the IRS takes all his refunds. I am preparing the 2007 returns this weekend. Northwest Log works (our company)is the only joint bank account we have. I have my own bank account in Canada where my paychecks get deposited. I have been married before (20 years ago) and my ex-husband just up and left me and took $58,000 – (cleaned it out) from our joint account so I am really paranoid about sharing the money that I have worked very hard to earn.

How do I get proof that our company bank account is joint can the bank write a letter?

The land we live on is in D’s parents name but he pays the mortgage on it. (He was also was burned in the past)

When we opened the Telephone account, I was the one who did it so it is in my name.

When the Dish TV was opened they would only open it in D's name because I did not have a SSN then.

No Utility bills because we run off-grid using Solar and generator.

I pay the Dish TV, telephone and medical insurance bills monthly and D pays the mortgage and fuel for the generator.

He doesn’t believe in insurance so we don’t have any life insurance on him (much to my dismay) I had to fight with him to get medical insurance. I have him as beneficiary on my work policy.

I am sure this is an unusual arrangement for our finances but it really works for us. We have never fought over money.

I was just thinking, Should I send a copy of Northwest Log Works Corp. W3?. It shows D and the only employee and me the one filling out the form.

If I do our 2007 taxes this year jointly, will I still get my refund on the money I pay or will it go to D’s back child support? He was the one to suggest filing separate because he said I should not have to pay for his child support. He hasn’t seen the kids in 15 years or so, I never met them they live out of state somewhere with their mother. D pays support every month but I guess a few years ago he was unemployed for quite a while and therefore has the back payments to make up. I don’t even know how much he owes. He doesn’t like to talk about it.

If we don’t have enough proof to satisfy USCIS, will they then request an interview or will they just deny. That scares me.

If you have any other suggestions, please let me know.

I had sent letter from D's parents stating that we live and work on the land that is in their name, numerous family pictures of us, cards addressed to us, Medical insurance in both names, Telephone, Dish TV, Company addressed separately but showing the same address.

I am so scared that they are going to deny me because I do not have enough proof. I almost feel that I should make an "adult movie" of us. Will that satisfy them?

None of these things are requirements. Supply what you can that proves bona fide relationship - affidavits from friends/family, covered on medical insurance, beneficiary on your retirement plan or payable on death beneficiary on your bank account or CDs . . . you should be just fine.

Evidence that you did not get married to evade the immigration laws of the United States. Examples of such evidence includes, but is not limited to:

Leases showing that you and your spouse live in the same place
Documents that prove that you and your spouse own property together
Birth certificates of your children

When you say "I have sent the request for evidence to my lawyer" does this mean that you have already filed I-751 and the USCIS sent you an RFE? Meaning that your original packet was not good enough evidence?
I haven't gone through the removal of conditions process yet, but will in 1.5 years, so since we got married in 2005, I have made sure that 90% of our stuff is in both names, so that I don't run into problems later. If the USCIS feels that you don't have enough proof of a bona fide marriage, I honestly don't know if they will deny you or request an interview... I honestly don't know.
What I do know is that if you file Married filed Jointly, the IRS will take the entire refund away to pay what your husband owes. In 2004, when my husband filed his taxes from years 2000-2003, he ended up owing money back to the IRS, but he got a refund from the State. When we filed Married filing Jointly for tax year 2005, the IRS took part of our State refund to pay off what he owed the IRS... pretty screwy if you ask me. So I'm sure this will happen to you too.

Yes, We filed the I-751 in February 2007. It has been an ongoing battle since. I am just learning my way around this site, but, in the introductions I posted the whole horror story. We ended up having to hire a lawyer after I got my nice Denial letter. :wha:
