hello to all. I'd just like to express my gratitude to all who take time to share advice and comfort. I've perused this site for some time now and am continually amazed at the knowledge and support of its members. My little families situation is so similar to many of those i've recently read about. It has now been 11 mos since my wife and two children returned to Mexico (Tasquillo, Hidalgo). I myself just returned from a two month visit to see my loved ones (needless to say, it was the most heartwarming and heartbreaking 60 days of my life). My resolve has been dealt a severe blow today. "Upon consideration, it is ordered that your Application for Waiver of Ground of Excludability (Form-I-601) be denied for the following reasons:".........who knew such mechanical and functional words could sway such strength????!!!!I now contemplate attacking my postman tomorrow for delivering such bad news. Nah...but today is the first time since our seperation that I'm dreading calling my wife and kids. I can't fathom the pain that those words will cause my loved ones to feel. Battered and beaten, we will continue this hollow and callous journey that my family has been made to endure. I wish my introduction to whomever reads this could be more hopeful. And I am sure that I will continue to make use of the support and info provided by many of you in the future. Thanks again.

Gary, I'm so sorry but don't loose faith. You can now ask for a second appointment and submit a stronger HSL. My thoughts and prayers are with you and yours.

May we ask what the reasons were that are listed on the denial?

Ohhh NO.. My heart is aching for your family. I can't even imagine what you are feeling. I felt this weird feeling in my stomach when I read what you wrote. I couldnt believe it. This is scary. Now I am scared to death for my case. You and your wife and children deserve to be with each other . THIS SUCKS!!!! The people who make these decision cannot possible have a heart. Please keep your faith and fight for your family to be together. DOnt give up.

The good news is that you can request a new interview and get it in 4-5 months. You'll submit a new HSL with better evidence and you could be approved on the spot through the pilot program.

Several members here have gotten approved on their second try.

Oh, I'm so sorry! Requesting a new appointment is your best bet! May I ask when you filed your waiver?

yeah, sorry, the decision was made due to lack of extreme hardship evidence. I do believe that a more detailed hsl with evidence to support the hardship claims could be written. The sense I get is that an appeal on this case is not the best route, no?

I believe you send a letter via fax requesting a second appointment and it never hurts to follow up with a letter via certified mail. Include a copy of your denial. Send to the attn of Santiago Burciaga. He's the top dog down there. Then call and make sure they got it.

Who's got the fax/phone# for Mr. Burciaga?

Thank you! Just trying to figure out where they're at..

That's pretty "fast" for a denial. They usually take about 14 months or so.

So sorry for your waiver denial - **** knows its been a hard last couple of weeks for peeps going through CDJ :( I can't even begin to imagine how it must be for those of you having to cope with what must be an emotional roller-coaster ride from hell :( Yes they may have denied you BUT with the help / support / advice / experience of the peeps on this site, many who are in the same position as yourself and your family then you WILL get through it :)

You should post your HSL (remove identifying deets) and let's see if we can't help make it stronger. Like I said there is a wealth of experience here (especially re: CDJ) and peeps are only too willing to help - a 'victory' to one gives strength and hope to all

I wish you all the luck in the world and remember no matter how many times they 'knock' you over it AIN'T over till YOU stop fighting!

Oh my god! I am sooooooooo sorry (these words don't even express what I feel for you right now). Hopefully you will be able to get another appointment soon and just have to wait another few short months to be able to spend the rest of your lives together. Please don't get discouraged and DON'T give up.

Don't appeal it. Get another appt. I am sorry that this happened. We will help you with your packet. Don't fret. Don't lose hope. A waiver denial we can help with...a bar we can't. We will get u thru this. Call ur wife and let her know and be strong because she won't be :)

Sorry Gary, therea few people here whom requested a second interview, I am one of them, I was denied back in september 2007, by I got the letter till january 2008.
I requested a new appointment and got an answer back in january 28th saying that they will scheduele an appointment between 4 or 6 months

You can see the post of Cristy Torres, la Morena, catinana, pinkbutter those menber had a second interview, or going to have one, Good luck
What I did is mail and fax them, but there are a few people that call Mr. Santiago and it work.

Thats very close to me ours was the 21st I wonder if they have sent my letter out yet.. when did the letter say that they decided on your denial? was it sometime in feb or jan?

There are a few who have been denied and asked for a 2nd appt. Your best bet is to re-write your hard ship letter and post it for those of us to read and give you editing advice.

Catiana who is on the Juarez forum waited for 3yrs and 3 mo's and asked for a 2nd appt, it took 4 mo's to achieve that, but they got it and then had some issues that took almost 2 wks to resolve, in that his finger prints got mixed up with some one else's but finally got him home in September!

Never give up Gary, you will succeed the 2nd time around!

If you need any help just let us know our Amigo. You will need to call the 900# for appts. or the $7.00 800 number that you can talk all you want to make a request for a 2nd appt.

So Gary's wife went for her waiver interview........at the interview did they tell here she was backlogged? She is staying in mexico since then, and so did they just sent out the letter that says she was denied after reviewing the HSL "more thoroughly"?

God is big and wonderful. If you have faith god will be by your side and will over come every obstacle. Keep your hopes up and don't ever give up. My prayers are with your family and to the members on this site.

Yes, that what happened. They won't actually deny someone at the waiver interview, just "backlog" them. Then if you get denied later on it will come in the mail.

Hi Gary, sorry to hear about your denial.but don't give up and please don't file an appeal..I did, well I with drew it..at the time you could email CDJ for a new interview..but since then..you have to either fax or send a letter..Pinkbutter and Corona have done that..Corona has gotten a new interview..and Pinkbutter is also waiting..when I first requested a new 2nd appt. they told me I would have to wait 4-6 months..that was back in Sept. 07..Oct 16, 2007..I got my packet and my new 2nd interview was Dec 27th..I got on the ball, wrote my own HSL posted it here on the forum..and Wavier appt. Jan 3rd..and we were approved..so don't give up hope..it will happen. And just think I wanted to wait out the Appeal..18 long months..I would still be waiting until Feb 09..I first thank god..and 2nd this wonderful site..good luck..and keep us posted..

welcome. the best thing is to request a new interview and submit a new waiver. YOu need to fax it to the consulate to request a new interview. Dont do an appeal, they take a long time and most people here have to cancel the appeal before they go to the new interview. Good luck to you....
