I was talking to an acquaintance last night who is also an immigration lawyer. At one point we talked about my applying for renewal of my EAD, and I told him most likely I’ll have to get an interim one. He said these days, the interim EAD isn’t “guaranteed” even if you go after 90 days! He said its been like this for the past year or so......that a lot of times when people make infopass appt. even after the 90 day mark, they’re told that their case is “pending” and not give the interim EAD.
Has anyone else experienced this?? I’m very freaked out right now. My lawyer’s assistants told me last week that I can go get an interim one. But this guy, who’s a practicing immigration lawyer, is telling me something else.
My lawyer sent in the 765 for renewal in the beginning of January. According to the USCIS processing times, right now they’re on November 30.
My notice date is January 31.
My current EAD expires on April 18.
So looking at all the dates, it’s highly unlikely I’ll get my EAD on time. I was planning on going for an interim EAD on the 91st day. I couldn't find any info. on the USCIS web site about this.
