View Full Version : NO CHANCE FOR WAIVER Please help Everything went bad

OK, my husband went for his 1st interview today. I've been working extremely hard on my hardship letter!!!! I had an incompetent lawyer at first who had submitted all our paperwork. He put that my husband came to the US in March of 99. He actually came in March of 2000. My husband didn't pay attention to the date ( you know how men are with dates) Anyway, he was caught and released at the border in 2000 when he was trying to cross. So as far as immigration goes, it looks as if he came twice; once in 99 and again in 2000. They didn't really give him a chance to explain himself and I know in all actually it's our fault because we should have paid attention. IS THERE ANYTHING WE CAN DO? I called the consulate and they suggested we get a lawyer. They said we would have to completely start over. HAVE YOU GUYS EVER HEARD OF A CASE LIKE THIS? PLEASE HELP WHAT CAN WE DO????

I'm sorry this happened. Maybe you can ask for a new interview where your hubby can explain the situation. Can he provide proof that he was in Mexico in 99?? School records, bank statements, a letter from the church???

I am so sorry...I agree that you should at least consulate with an attorney to find out what your options are. If I were you I would talk to Laurel Scott, at least for an initial consult. Unfortunately it seems that once they make a decision it can take a long time to get them to reconsider. Good luck!

ouch!! I really don't know what to tell you, but I wish you luck! Do what pooh said try to prove he was in Mexico the dates the said he entered. Good Luck!

Why didn't they let him explain, my sister in law had her appt last week and her attorney made an error on the application he listed that she came in 1/99 and she was able to explain to the officer that it was 10/99, plus she was caught and release and she was able to file a waiver which is next week! what questions did they asked?

so they have him down coming once is 99 and then in 2000? it doesnt make sense, i cant believe they didnt let him explain. do you have an update ds-230 showing the correct date? you should call and see what has happend. did they give him a ban?

I assume the problem is that you did not bring it up initially -- meaning point out the error on the paperwork BEFORE any questions were asked. It would have been best to handle it there are that moment. I have no idea how you could go about getting this clarified - maybe Laurel can answer in her chat?

Whoa! That's terrible! I hope you can get it overturned. I'm not sure what you should do.. I would suggest you do a consult with Laurel Scott, it will only cost $125 and she will be able to help you hopefully get this straightened out. The fact that he was (I'm assuming) sworn in during the visa interview and was sworn to accuracy when filing out the forms makes this really tricky though...

I think CDJ is being so strict, Before my sister in law left I literally had to train her on how to bring this up and to make sure that she tell the officer and the lady that verify all her documents on the error and she did not have any type of problem, but they were so strict with her catch and release, he almost did give her the okay to file the waiver!!

I just want to add that I am so sorry.
My heart breaks for you having to deal with such a ridiculous mistake :(

Hopefully Laurel or someone will be able to guide you on fixing it. There must be a way!

I don't know what their deal is down there...they should have heard your husband out...def. get a lawyer and fight this..it is NOT fair!! :mad:

Wow, this is really a tough break and I'm sorry. I know that you are really torn apart right now. But if the consulate said that you needed to start all over, at least you have the consolation that you weren't completely shut out - there is still hope. It would be horrible if they said you were banned. Laurel should be able to help you make the decision to start over or to try to fix this case. Good luck.

I am sorry to hear of your denial. To echo everyone else, please do a consult with Laurel. There must be something that could be done. Also, it would be a good idea to gather as much evidence as possible to prove that he was in Mexico in 1999, just in case.
