Hi All!

So here's my situation: I was once married before to a Taiwanese man and I had filed the I-129 for him. The relationship turned sour and we were both young and stupid at that time. We had separated 2 years but just recently filed for divorce. Now, my fiance was deported to Australia and I'm going to have to file all the necessary paperwork. My question is would I have to wait for the final divorce decree in order to fill out the I-129 for my fiance? All it says is to provide the divorce date so I'm thinking they don't need proof. Let me know if I can go ahead with the process.

Thanks

In the instructions for filling out the I-129F it states that you must send a copy of the divorce decree for either spouse, if you have been married in the past. It is in section 5D:

D. If either you or your fiancé(e) were married before, give copies of documents showing that each prior marriage was legally terminated.
