View Full Version : Getting married soon and need some guidance with the filing

Hi there everyone,

I am a bit lost with the whole prosses of AOS and need some help...:shy:
I entered the US about 3 years ago under a tourist visa but never left. My other half and I also have a 8 month-old baby boy and are about to get married. I have read a lot of postings on this webside but also did some reading on the immigration webside. It is very overwhelming to read what you have to do to get your "****" right...lol
What forms exactly do I have to send in to get my papers? I also want to work while we are waiting. What form would that be? We currently live in Michigan and are going to move to Massachussetts in the middle of the year. I was thinking to give them a PO Box address in Massachussetts (Boston) since my boyfriend already works and lives there during the week. If I would give them our Michigan address I would have to file with Chicago and I don't want to do that since we are moving to Mass. anyways. Does somebody know if they would except a PO Box address?

Welcome...I am not very familiar with the AOS process, but someone who has done it recently can help.

All AOS gets filed in Chicago. Make sure you do a change of address form once you move.

have you filed anything before doing your AOS. I don't know much about the tourist Visa, but is it still valid or has it expired?

We started with the I-129F, which is for Fiancee's and you recieve a K-1 Visa. Then once we were approved, we had to go to Ciudad Juarez, Mexico for an interview, then file for a waiver. Once we were approved with that, we then got married within the 90 day period of time and then sent our AOS packet.

AOS from another visa type like a tourist visa is different than AOS from a K1 or K3. Go by the link I posted which is AOS and concurrent filing of an I-130 rather than the K1-K3 information. You'll need proof of your legal entry.

if you do not have your i-94 on hands you should request evidence of legal entry ASAP

Thanks a bunch for all of the reply's I got from you. Especially the once with links to certain web sides :thumbup: I guess I have to do more reading...lol I see more clearly now.
But is there somebody out there that has been in the same position then I am in right now and would like to share his story?

I came on a VWP and overstayed and never left and everything went fine.

Just do not leave until you have your green card in hand. It's pretty straight forward for you from here on out. Just keep in mind that until that paperwork is filed, they can deport you. Being married won't stop anything either, so after you get married, file as soon as you can.

Hi! My husband and I married Dec 2007 he came here as a 12 year old in 2001 and overstayed his tourist visa.. sounds similar situation. We're about to be ready to mail everything. Send me a private message if you have specific questions that I could help you with, and I can probably help!
