Hmmm. It has been posted that some of that stuff does not show up on the FBI finger print check and it may come up when you go through the waiver process. Try doing an FOIA.

You may also have signed a voluntary departure form.
Are you concerned whether or not you were deported?

This happened with my husband too. We tried to drive through the El Paso border and were stopped because we didn't have the "proper entry documents" for my husband. They asked him a lot of questions. We were there for 6 hours. They took his fingerprints and his picture (like he was some-kind-of criminal). We DID NOT claim that he was a US Citizen; only that "We were working-on-it". That is probably the only thing that saved us from a life-time-ban. He signed something saying that "he withdrew his application to enter". This was not used against him at the 1st interview. This was NOT considered a deportation. He did, however, have to file a 601 because he had previously been in the US for 7 years EWI (entry without inspection).

My fiance also signed "something" when he was caught on his first attempt. He says he thought it was just like a booking when you are put in jail but not for sure. He was only in the US for a couple hours before being sent back. So does the "withdrawing your application to enter" and the "voluntary departure not affect your ability to file the waiver?

You do sign something when you are caught and released. If it didn't show up on the FBI check it's highly unlikely to be anything other than a catch and release.
