Who filed your advisory opinion and how?

We filed 2. The first was sent from the embassy and an answer came back in about 6 weeks. The second was filed by my attorney and after hounding them first weekly calls after 6 months waiting and then daily calls, we finally got an answer after 8 months.

BTW, their answers were worthless in my mind, as far as actually interpreting the law. What it was was a derogatory opinion that said they decided to pick and choose the law to fit their needs, not actually apply the law to the facts of the case.

But hopefully, they will do a better job for you.

this is for waiver ..212(d)(3) i applied for L1 NIV and after fingerprints and interviews they said they are going to request a waiver for me .. 4 weeks later when I sent and enquiry email

they responded which says ..tht they have requested state dept wshington dc for my waiver review and its pending ..so i am assuming they are waiting for an advisiory opinion.

I did call dos number and all they could say is pending..and we dont know .but when i ask is it pending adminsitrative processing she said yes. are they waiting for advisiory opinion she said yeah ..are they waiting for security clearence .she said yess ..is this for wiver she said yes ..its seemd shes saying yes for everything .

thats what she said for previous AP ..nd its been done aleady 4 months ago now i wonder what i am waiting for

During the interview VO did say i am going to request waiver for you and it will take about 4 to 6 weeks .its been 12 weeks now no news

Did you file the I-192 for the NIV waiver? I don't have much experience with this route, but did research it as an option at one time. We never went further with it than that.

I believe though that the waiver goes to a different place than the DOS Advisory Opinion office. If that was the form you used, it is a USCIS form, so I would expect it is sent from DOS to USCIS for actual adjudication. I have heard others took up to a year to get answer on the NIV waiver.

Try searching on visa journey. I believe there was some history on that site of others that tried this route and may have better idea of the timeline.

no blublue i didnt apply use i-192 i applied L1 at consulate when applied at consulate u dont need any form consulate fawards its recomendation to DHS in case of multiple entry and long term visas ( more than 1 yr) they are mandated to request DOS advisiory opinion in which case DOS desides and sends its recomendation which consulate farwards to DHS.

as per the reserch i have done and FAM all advisiory opinions go to CA/V/O/LA
including J waiver and there is only one peson who is incharge of it i am hoping this will all workout prety quick.

lawyers are ot failie with 212(d)(3) as they are rarely involved in such cases.
