HELLO TO ALL...
I just went to a interview an RIO last Feb/22 for a CR1 and everything was looking fine, my hasbund was with me, but at the end she said that i need a waiver under section 212(a)(9)(B)(i)(II)...ilegal presence for more then 1 year...i was preparing myself for this...but like always we was expectiing a miracle, anw... they gave me a 601 form, ds-230, questionaire, and other pappers...but the schedule another interview in 2 weeks....im afraid about this interview...i know that i have to give them the package , but why to be interviewd again???
my husband explain the consul that he can not be here at the next interview and she said its fine...im scared...i dont understand why they need to interview again?? its confusing, im scared ...its about my CR1 again??? 90

Any body from brazil here who can answer me about this interview...thats any special thing that i need to be aware?
its normal?? or they may wanna talk to me about my marriage again??
the consul never ask for pictures or anything else , she only ask normal questions, but at the end she said un fortunatly she can gave me the visa because i need a waiver first...

Also my passport is expiring in july, i like to know if they will stay with my passport or not....if they send the passport to lima too...or i will have time to renew my passport and after the waiver approved i can take the new one???

and regarding the fees....thats a 545,00 fee that i have to pay there, but theres other $90 fee for 601 form...i dont know whre should i pay this?? or should i bring in cash with me to RIO ..or send to them...i could find any address....

i really appreciated if anybody can give me any info...

When you go back you will have to submit your waiver package which includes your harship letter and the various forms you were given. This will be sent to DHS in Lima Peru to be adjudicated. This will take about 8 months. You pay the fees at the consulate. I think you will have to renew your passport, they don't send it to Lima.

HI, TNKS FOR BE SO FAST....REGARDING THE $90 FEE..IN THE PAPPER SAYS U CAN PAY IN CASH, HAS TO BE IN CHECK OR MONEY ORDER..THATS WAHY I WAS SO CONFUSED....
AND WHY THEY SAY I WILL BE INTERVIEWED AGAIN? DO U KNOW...

SORRY, BUT ALL THIS IS SO NEW FOR ME ...AND IM JUST TRYING TO DONT LOSE MYSELF...

It won't be much of an interview, it is basically to submit your waiver and answer any remaining questions. You will have no problems as long as you tell the truth. Naturally you will be nervous as this whole process is nerve racking. Stay calm and you will be fine. Make sure you have a strong hardship letter before you go back to Rio, even if you have to change your appointment to a later date. This is the most important part of the process.

If your waiver is approved, you will have to go back to Rio for another interview for your visa.

Thanks Again!!! I Will Work On Thsi Hsl Now For The Next 2 Weeks...i Have Done Many Things For All This Months Witch Have Been Passed ..but Still..im Trying To Make Stronger...
How Was Your Letter...mine Is Too Big...im Afraid If They Get Tired Reading...should I Resume Better...and Make Smaller???

You can post it here and get some opinions from other forum members. The important thing is to document the hardships with supporting evidence. Do you have strong hardships?

I Dont Know If Its Strong...my Husband Has High Blood Pressure + Colesterol, For More Then 3 Years , Also He Need To Have A Surgery In His Left Hand , With Docs Letter, He Is Self Employed, And Is A Investor....he Has 3 Kids Form His First Marriage That He Need To Pay Every Month...and Also He Is Dignostic With Depression....i Have Some Family Letters Too...i Dont Know If I Have A Strong Case..i Cant Find Anything Else To Put Together...im Just Going Crazy....

The letter has to be written by him and it must show extreme hardship to him if you are not allowed to enter the US and he has to move to Brazil. They don't care about hardship to the non citizen and they don't care about the separation. Medical issues suppported by doctors letters are good. Health care is better in the US than Brazil, etc. Your husbands work could be a good hardship. Could he find gainful employment in Brazil? What does he do for work? Does he speak Portuguese? Does he have a strong relationship with his children? Does he visit them frequently? Paying child support is important.

Read the hardship letters posted here to get some ideas. He has to dig deep and think of harships. What about his family, any parents that depend on him, etc? You both need to do a lot of reading here.

If you need to change your interview to be better prepared, then do it soon. This letter is your life. You both need to do the best job possible.
