I did not see a similar thread on this forum and thought it would be helpful to concentrate on help, advice, and tips for filing a 601 INSIDE the US.
My situation is this: our I-130 was approved, but the I-485 denied. We have hired a well respected attorney in the Detroit area who is filing a motion to reopen the 485 with a waiver. I have heard conflicting information on the need for an attorney, and truthfully, he is quite expensive. Money is tight for us right now but the attorney seems to be quite confident that a motion CAN be filed and that we have a strong case, in terms of hardship.
Has anyone here filed a motion to reopen on their own? What is involved with this process? Is this something that we can do without an attorney?
Now in asking that, what are the steps that we should anticipate after filing the motion? The attorney said he was going to request 90 days to gather evidence for the waiver, and again feels confident that we will get it. I'm just a little in the dark with WHO approves the hardship in the US? Does this go before a judge, or an adjucator?
If anyone can shed some light on this process here in the good ole USA, it would be most appreciated!!
